# California Prop 65 Compliance Handbook

A Prop 65 handbook for electronics manufacturers: listed chemicals in electronics, safe harbor levels, exposure assessment, warning rules and e-commerce. California's Proposition 65 is one of the most misunderstood laws an electronics company will ever have to comply with — not because it's technically complicated, but because it behaves so differently from the chemical restriction regimes most manufacturers already know. RoHS and REACH ban a substance above a fixed concentration threshold. Prop 65 does something else entirely: it asks whether a real person's anticipated exposure to a listed chemical exceeds a specific daily dose, and if so, requires a warning rather than a ban. A product can pass RoHS and still need a Prop 65 warning. A product with a high chemical content can be entirely legal in California with the right warning attached. This book is a complete, standalone reference for getting that decision right, built specifically around the compliance landscape as it stands going into 2026: the short-form warning overhaul that took effect in 2025 and reaches its hard compliance deadline on January 1, 2028; the new chemical listings, including Bisphenol S, that landed in December 2025; and the 2026 Omnibus rulemaking package currently moving through public comment at the Office of Environmental Health Hazard Assessment. It covers the legal framework from the ground up, the specific chemicals that actually show up in cables, batteries, housings, and circuit assemblies, the exact safe harbor math behind every warning decision, testing methodology, the precise content and format the law requires of a warning, e-commerce and supply chain obligations, exemptions and real defenses, and what actually happens — procedurally and financially — when a sixty-day notice arrives. Whether you're building a compliance program from scratch or auditing one that's gone stale since your last product launch, this book is organized to be read start to finish once, then kept as a working reference you return to before every new product ships.

## What you'll learn

* Explain why Prop 65 is a warning-and-disclosure statute, not a ban-and-limit regime like RoHS or REACH
* Classify any electronics product against the four scope gates and know exactly who in your supply chain is liable
* Identify the chemicals of concern that actually show up in cables, batteries, housings, connectors, and circuit assemblies
* Calculate exposure against NSRLs and MADLs, and know which lab methods actually test for which chemicals
*   Write a fully compliant long-form or short-form warning, including the 2026 chemical-naming requirement
* Navigate the short-form warning transition to the January 1, 2028 deadline and the 2026 Omnibus rulemaking package
* Build supplier material declaration requirements and a defensible chemical documentation trail
* Respond correctly to a 60-day notice, and build a real compliance program with named ownership and a recurring calendar

1

The Big Picture: Why Electronics Companies Keep Getting This Wrong

Prop 65 warnings are everywhere in consumer electronics, and almost nobody in the supply chain that puts them there can fully explain why a specific product …

2

The Legal Framework: Where This Law Actually Comes From

Understanding why Prop 65 is structured the way it is starts with its unusual origin: a 1986 ballot initiative, not an ordinary statute.

3

Who Actually Enforces This

Most regulations are enforced by a single agency on its own schedule.

4

Scope: The Four Gates

"Does this even apply to us?" is the question every company asks first, and it's answered correctly by running four specific gates in sequence rather than a …

5

The Chemical List

Every obligation in this book traces back to one document: the list of chemicals OEHHA has determined cause cancer, reproductive harm, or both.

6

Chemicals of Concern in Electronics

Of the more than nine hundred chemicals on the Proposition 65 list, a relatively small subset does almost all the work for electronics manufacturers.

7

Safe Harbor Levels: The Math Behind Every Warning

No Significant Risk Levels and Maximum Allowable Dose Levels are the two numbers that actually decide whether your product needs a warning.

8

Exposure Assessment in Practice

Knowing the safe harbor numbers is only half the job.

9

The Warning Requirement

A warning that's chemically accurate but wrongly formatted or poorly placed is still a violation.

10

The 2026 Omnibus & Short-Form Warning Overhaul

A short-form warning overhaul adopted in 2024, effective January 1, 2025, is now mid-transition toward a hard January 1, 2028 deadline — and a separate 2026 …

E-Commerce & Internet Warnings

A perfectly worded on-product warning does nothing if a product ordered online ships without ever showing that warning before the sale completes.

Supply Chain & Component Documentation

Every classification decision in this book depends on genuinely knowing what's inside your product — and for most electronics companies, that knowledge lives…

Exemptions & Defenses

Not every exposure needs a warning, and not every notice is automatically valid — but the exemptions and defenses that actually hold up are narrower than com…

14

Enforcement & Litigation Reality

If a sixty-day notice does arrive, how a company responds in the first few days matters enormously.

Building Your Compliance Program

This chapter is the operating system underneath everything covered so far — how a real company runs Prop 65 compliance continuously, with named ownership and…

Common Mistakes & Edge Cases

Careful companies still make specific, recurring mistakes — usually not from ignorance of the basics, but from edge cases the basics don't obviously cover.

Your Compliance Action Plan
