# India DPDPA Compliance Handbook for Hardware

An India DPDP Act handbook for hardware companies: the Act and Rules, consent, children's data, Significant Data Fiduciaries and cross-border transfers. Somewhere in a hardware company's companion app right now, a screen is asking an Indian customer for permission to collect their data — and almost nobody on the team can say with confidence whether that screen would survive a challenge under India's Digital Personal Data Protection Act. The Act received Presidential assent in August 2023. Its final Rules were notified only in November 2025, and a phased, eighteen-month rollout is still actively unfolding as this book is being written — which means the law is already fully binding, even while the institutions built to enforce it are still coming online. This book is a complete, standalone reference for building DPDPA compliance into a connected hardware product from the ground up: the legal architecture behind the Act and its Rules; who counts as a Data Fiduciary, Data Principal, or Data Processor; Section 6 consent standards and Section 7's nine legitimate uses without consent; Section 8's general obligations, including the seventy-two-hour breach notification clock; the strict children's data framework, where a child is anyone under eighteen and two categories of processing are prohibited outright regardless of consent; Significant Data Fiduciary obligations; the emerging Consent Manager framework and cross-border transfer rules; and — critically — the current live status of enforcement itself, since the Data Protection Board of India is still not fully operational as this book is written. Whether you're building a compliance program from scratch or auditing one that's gone stale since your last product launch, this book is organized to be read start to finish once, then kept as a working reference you return to before every new product ships — and revisited specifically once the Board becomes fully operational, the Consent Manager framework goes live, and the first cross-border transfer notifications are published.

## What you'll learn

* Explain DPDPA's legal architecture — the Act, the Rules, and the phased transition still actively unfolding
* Determine exactly who is covered as a Data Fiduciary, Data Principal, or Data Processor, including extraterritorial reach
* Apply Section 6 consent standards and Section 7's nine legitimate uses without consent to real hardware scenarios
* Meet Section 8's general obligations, including the 72-hour breach notification clock and grievance redressal
* Build a compliant children's data program — verifiable parental consent and the two prohibitions that override any consent
* Determine Significant Data Fiduciary status and build toward its heavier audit, DPO, and localization obligations
* Track the live status of the Data Protection Board, the Consent Manager framework, and cross-border transfer rules
* Build a complete compliance program — data mapping, consent architecture, security safeguards, retention, and horizon-scanning
