# Authorized Economic Operator (AEO) Program in India

India's AEO program transforms the customs experience for qualifying importers — Direct Port Delivery eliminates CFS charges and delays, deferred duty improves cash flow, and reduced examination rates lower operational uncertainty. For companies importing electronics or hardware regularly, AEO can recover its application investment in a single large shipment.

## AEO application process

01

### Check eligibility and prepare compliance evidence

Verify your import/export history meets minimum transaction thresholds. Compile compliance record: no major Customs Act violations in preceding 3 years, no criminal proceedings, financial solvency documentation.

02

### Complete AEO application form

Complete the AEO application form (available on CBIC portal). The application covers: company details, import/export profile, internal control systems, security measures, and quality management processes.

03

### Submit application to jurisdictional Principal Commissioner of Customs

AEO applications are submitted to the jurisdictional Principal Commissioner of Customs (Customs Preventive/Air Cargo/Port). The authority assigned depends on your primary port of import/export.

04

### AEO audit and verification

Customs AEO officials visit company premises to verify: import/export records and systems, internal controls, security infrastructure, and staff training on customs compliance. Honest, prepared responses accelerate approval.

05

### Receive AEO certificate and activate benefits

Upon approval, AEO certificate is issued. Register the AEO status with your customs broker. AEO status is reflected in ICEGATE and customs systems — clearance benefits activate automatically for AEO-flagged shipments.

## AEO benefits explained

### Direct Port Delivery (DPD)

AEO importers receive goods directly at their premises from the port without going through the Container Freight Station (CFS), saving 2–5 days and ₹10,000–40,000 per container in CFS charges.

### Deferred duty payment

T2 and T3 AEOs can defer customs duty payment for up to 15 days after clearance, improving cash flow without need for bank guarantees on each shipment.

### Reduced physical examination

AEO shipments are selected for physical examination at significantly lower rates (typically under 10%) compared to non-AEO importers. This saves time and reduces risk of damage during examination.

### Priority documentation processing

AEO importers' Bills of Entry are processed on priority at the customs station. Queries and deficiency notices are handled by dedicated AEO facilitation officers.

### Mutual recognition agreements (MRAs)

India has MRAs with USA (CBP), South Korea, Hong Kong, and is negotiating with EU and others. MRA means Indian AEO importers receive facilitation from partner country customs for Indian-origin exports.

## Frequently asked questions

### Does AEO status reduce the regulatory compliance requirements from BIS, WPC, or other regulators?

No — AEO status is purely a customs trade facilitation benefit. It does not reduce or waive any product compliance obligations from BIS, WPC, TEC, CDSCO, or other regulatory bodies. AEO status means customs trusts your trade processes and gives you faster clearance, but every import must still carry all required compliance certifications (BIS CRS, WPC ETA, etc.) and correct documentation. AEO and product compliance are parallel, separate obligations.

### How long does AEO status last and must it be renewed?

AEO status is granted for 3 years and must be renewed before expiry. During the validity period, customs may conduct periodic reviews if compliance issues arise. Any significant customs violations during the AEO period can result in suspension or cancellation of AEO status. Renewal requires submitting updated compliance evidence demonstrating continued eligibility under the AEO criteria.

### Can a foreign manufacturer apply for AEO in India?

No — India's AEO program is for entities that are legal persons under Indian law and are engaged in customs clearance activities in India (importers, exporters, customs brokers, warehouse operators). A foreign manufacturer who ships goods to India cannot directly hold AEO status. However, their Indian importer or Indian subsidiary can apply for AEO status, and the benefits flow to the shipments they import.

**Disclaimer:** AEO program criteria, benefits, and approval timelines are set by CBIC and subject to updates. Always verify current AEO criteria and application procedures on the CBIC portal (cbic.gov.in) before applying.
