# CE Marking for Construction Equipment

Construction equipment CE marking combines the Machinery Directive's Essential Health and Safety Requirements with Outdoor Noise Directive sound power limits for 22 defined equipment types. Noise compliance requires both measurement testing and marking the guaranteed sound power level on the machine — not just in the documentation.

## Applicable legislation

Machinery

### Machinery Regulation 2023/1230 / Directive 2006/42/EC

All self-propelled, remote-controlled, and powered construction equipment. Essential Health and Safety Requirements (EHSRs) cover guarding, controls, stability, visibility, electrical systems, and emergency stop functions.

OND

### Outdoor Noise Directive 2000/14/EC

Covers 22 specific equipment types including concrete breakers, compactors, compressors, crawler dozers, dumpers, excavators, graders, loaders, mobile cranes, and tower cranes. Mandates guaranteed sound power level limits and measurement per EN ISO 3744/EN ISO 3746.

EMC

### EMC Directive 2014/30/EU

Construction equipment with electronic control systems — GPS machine control, load monitoring systems, remote control systems. Must not generate harmful electromagnetic interference or be degraded by it.

ATEX

### ATEX Directive 2014/34/EU (where applicable)

Construction equipment for use in potentially explosive atmospheres — confined spaces with explosive gas, underground mining applications. Much rarer for general construction but critical for relevant specialised equipment.

## Outdoor Noise Directive — example sound power limits

EquipmentLimit (LWA)Status

Compaction machines (soil roller) ≤ 8t

105 dB(A)Current limit (Phase II)

Compressors ≤ 15 kW

97 dB(A)Current limit

Concrete breakers and picks (handheld)

109 dB(A)Current limit

Excavators ≤ 15t (diesel powered)

101 dB(A)Current limit

Mobile cranes

105 dB(A)Current limit

Tower cranes

98 dB(A)Current limit

Limits from Directive 2000/14/EC Annex III — verify current limits for your specific equipment type and power rating.

## Key harmonised standards

EN ISO 4413

Hydraulic fluid power — general rules and safety requirements for systems and their components (earthmoving machinery hydraulic systems)

EN ISO 3744

Acoustics — determination of sound power levels of noise sources using sound pressure — engineering method (noise measurement for OND compliance)

EN ISO 2631-1

Mechanical vibration and shock — evaluation of human exposure to whole-body vibration (WBV declaration for ride-on equipment)

EN 474-1

Earth-moving machinery — safety — general requirements (covers dozers, loaders, excavators, graders, scrapers)

ISO 3471

Earth-moving machinery — roll-over protective structures — laboratory tests and performance requirements (ROPS for earthmoving equipment)

ISO 3449

Earth-moving machinery — falling-object protective structures — laboratory tests and performance requirements (FOPS for earthmoving equipment)

## Frequently asked questions

### Does the Outdoor Noise Directive apply to all construction equipment?

No. The Outdoor Noise Directive 2000/14/EC applies to a defined list of 22 equipment types specified in its Annex I. Equipment not in this list is not subject to OND sound power level limits, though it may still need machinery directive noise/vibration declarations. The 22 covered types include most common construction equipment categories — compactors, concrete breakers, excavators, loaders, cranes, compressors — but not all construction site machinery.

### What whole-body vibration declaration is required for construction equipment operators?

The Machinery Directive requires manufacturers to declare whole-body vibration (WBV) emission values per EN ISO 2631-1 for ride-on construction equipment. The declaration must state the emission value in m/s² RMS and whether it was measured per applicable test codes or determined by comparison with similar machines. Operators use these values to calculate daily exposure per the Physical Agents (Vibration) Directive 2002/44/EC and determine when operator health surveillance is required.

### Does ROPS certification for construction equipment differ from agricultural ROPS?

Yes. Agricultural tractor ROPS testing references OECD test codes. Earthmoving equipment ROPS is tested per ISO 3471, which specifies the energy absorption and deformation requirements based on the machine's operating mass. The performance requirements differ — construction equipment test loads are derived from the machine mass and ISO 3471 calculation formulas, whereas OECD agricultural codes have separate test procedures. Ensure the correct test standard is referenced in the technical file for your equipment type.

### Are remote-controlled demolition robots considered construction equipment for CE marking?

Yes. Remote-controlled demolition robots are machinery under the Machinery Directive/Regulation. They require CE marking covering the mechanical safety design, control system, ROPS/FOPS equivalents for the operator station (if present), and noise and vibration where the OND and Machinery Directive requirements apply. Radio remote control systems also require RED CE marking for the radio controller. The complete machine system — robot and remote control — needs a coordinated CE assessment.

**Disclaimer:** Educational resource only. OND noise limits and Machinery Directive EHSRs for construction equipment require specialist knowledge. Always verify noise limits for your specific equipment type and rating from current directive text.
