## Two regulatory paths

### Medical Device Regulation (EU) 2017/745

Applies to devices intended for diagnosis, prevention, monitoring, treatment, or alleviation of disease. Includes Class I, IIa, IIb, and III devices with increasing scrutiny and Notified Body requirements.

### General CE Marking Directives

Applies to devices that are electronic but not intended for medical purposes. Includes LVD, EMC, RoHS, RED, and other directives. Self-certification is typically possible under Module A.

## How to determine which path applies

The primary factor is the manufacturer's intended use. If the device is marketed for medical diagnosis, monitoring, or treatment, it falls under MDR. If marketed for general consumer use, it follows general CE directives.

Marketing claims

Review all marketing materials, websites, and documentation. Medical claims (diagnoses, treats, monitors) trigger MDR. Wellness claims (tracks, measures, displays) typically fall under general CE marking.

Software classification

Software that drives medical devices or performs medical calculations is regulated under MDR. General health and wellness apps typically fall outside MDR scope.

## Frequently Asked Questions

### Is a fitness tracker a medical device?

Generally no. Fitness trackers that monitor steps, heart rate, or sleep for wellness purposes are consumer electronics under general CE directives (RED, EMC, RoHS, GPSR). However, if marketed specifically for diagnostic or therapeutic use, they may fall under MDR.

### What about smartwatches with ECG features?

Smartwatches with FDA-cleared ECG features typically fall under MDR because they provide medical diagnostic information. The ECG functionality requires MDR compliance, while general smartwatch features follow general CE directives.

### Do I need a Notified Body for medical devices?

It depends on the risk classification. Class I devices (non-sterile, non-measuring) can often self-certify. Class I sterile/measuring, Class IIa, IIb, and all Class III devices require Notified Body involvement. The classification rules in MDR Annex VIII determine the category.
