# CE Marking for Prototypes and Pre-Production Hardware

The key question for any hardware startup is: at what point does CE marking become mandatory? The answer is when the product is placed on the market — and that boundary is often crossed earlier than most teams expect.

## CE marking obligations by development phase

### Internal R&D prototype

Units used solely for internal development and testing by the manufacturer do not need CE marking. They are not placed on the market. Ensure they are clearly labelled as not for sale or distribution.

### Prototype sent to a contract manufacturer for evaluation

Generally no

Sending hardware between manufacturers in a B2B supply chain for evaluation does not constitute placing on the market. However, if the CM is considered an independent purchaser who could resell, the analysis changes.

### Units shown at a trade fair or exhibition

Conditional

Units displayed at exhibitions may be displayed without CE marking, provided they carry a notice stating they do not conform to EU law and will not be made available until made compliant. They must not be used or demonstrated in ways that create risks.

### Pilot production units sent to beta customers

Yes

Once hardware is supplied to an end customer — even one customer, even a friendly beta tester — the product is placed on the market and CE marking obligations apply.

### Crowdfunded products shipping to backers

Yes

Crowdfunding fulfilment is placing products on the market. CE marking must be complete before shipping to backers, not after.

## Frequently asked questions

### Can I show my prototype at CES or Electronica without CE marking?

EU trade show rules allow products not yet in conformity to be demonstrated at exhibitions, provided they are clearly signed as non-compliant and not available for purchase. In practice, many hardware companies show prototypes at events before CE certification is complete — but this requires clear non-sale notices on the product and exhibit, and the product should not be used in demonstrations that create risk.

### What if I ship one unit to a reviewer or influencer for coverage?

Supplying a unit to a reviewer, journalist, or influencer constitutes placing it on the market — they receive the product, and it may be further distributed or used by others. CE marking obligations apply. 'It's just a sample' or 'for press only' is not a legal exemption.

### How complete does the technical file need to be at first sale?

The technical file must be complete and available at the time the product is placed on the market — not assembled retrospectively after the fact. In practice, the EU DoC, CE mark, test reports, and risk assessment must all exist before the first sale. The file doesn't need to be submitted anywhere, but it must be available to authorities on request within 10 days typically.
