# CE Marking and Product Recall Under EU Law

CE marking is not a defence against a product recall — it shifts the burden of proof but does not prevent enforcement action if a safety issue emerges in service. Under GPSR 2023/988, manufacturers must have in place the processes, traceability, and consumer communication capability to execute a recall before they ever need one.

## What triggers a product recall

### Self-identified safety defect

Manufacturer discovers during production, testing, or post-market monitoring that units already on the market have a safety issue. Proactive corrective action initiated by the manufacturer before any incident.

### Consumer incident or complaint

A consumer reports an injury, near-miss, or dangerous condition caused by the product. Manufacturer must investigate, assess severity, and determine whether corrective action is required.

### Market surveillance authority notification

A national MSA identifies a non-compliant or dangerous product during surveillance. The manufacturer receives a formal notification and may be required to take corrective action within a specified timeframe.

### RAPEX / Safety Gate alert from another member state

An MSA in another EU member state identifies a safety issue and notifies the Safety Gate system. Other member states and the manufacturer are informed; coordinated corrective action may follow.

## Product recall execution steps

01

Immediately stop supply of affected products to distributors and retailers — identify the batch range affected by lot number, serial number, or date of manufacture.

02

Conduct internal safety assessment to determine the nature of the hazard, scope of affected units, and severity of risk to consumers.

03

Notify the relevant national Market Surveillance Authority within the timeframe required by GPSR — serious risks require notification without delay.

04

Submit Safety Gate notification if the product presents a serious risk and has been supplied to more than one EU member state.

05

Contact distributors and retailers to stop further sale, retrieve stock, and provide instructions for handling recalled units.

06

Communicate to consumers directly where possible (contact databases, registered users) and through public communication (website notice, press release for serious risks).

07

Provide consumers with a remedy: repair, replacement, or refund. The remedy type must be proportionate to the risk and clearly communicated.

08

Document all corrective action steps, units recalled, consumer contacts, and closure of incidents. Retain records for the duration required by applicable regulations.

## Frequently asked questions

### What is the difference between a voluntary recall and a mandatory recall?

A voluntary recall is initiated by the manufacturer or economic operator without being formally required by an authority. A mandatory recall is ordered by a market surveillance authority under their legal powers. In practice, the practical steps are similar — stop supply, notify consumers, provide remedy. However, mandatory recalls come with tighter timelines, formal compliance documentation, and potential enforcement action if not completed as specified. Voluntary recalls initiated proactively before authority involvement typically result in better outcomes for manufacturers.

### What is the Safety Gate (RAPEX) system?

Safety Gate is the EU's rapid alert system for dangerous consumer products. When a market surveillance authority identifies a product that presents a serious risk to health or safety, they notify Safety Gate. The notification is shared with all EU member states' MSAs, the European Commission, and is publicly visible on the Safety Gate website. Manufacturers whose products appear on Safety Gate must take coordinated corrective action across all affected EU markets simultaneously.

### How should consumers be notified of a product recall?

GPSR requires manufacturers to communicate recalls to consumers in a way likely to reach them. For registered products, direct contact (email, postal letter) is required. For unregistered products, public notices through the manufacturer's website, social media, retailer notification, and media releases are standard. The recall notice must clearly identify the product, describe the safety hazard, explain what consumers should do, and provide the remedy offered. Clear, plain language is essential — technical regulatory language is not appropriate for consumer-facing recall communications.

### Do CE-marked products still get recalled by authorities?

Yes. CE marking demonstrates conformity at the time of placing on the market, but it does not immunise a product from recall if a safety issue is discovered in service. Market surveillance authorities can require corrective action, market withdrawal, or recall even for CE-marked products if they identify that the product presents a risk in practice. CE marking shifts the burden of proof — authorities must demonstrate non-conformity — but it does not provide absolute protection against enforcement.

**Disclaimer:** Educational resource only. Product recall management involves legal obligations and potential liability — always consult qualified legal and product safety professionals when managing a recall situation.
