# EU Customs IP Enforcement for Hardware Brands

Counterfeit chargers, batteries, and accessories entering the EU create both lost revenue and real safety liability. EU customs authorities offer a formal, EU-wide mechanism for rights holders to have suspect shipments detained at any member state border -- filed once, enforced across the bloc.

## Why EU-wide filing matters for hardware brands

### One filing, many borders

A Union AFA -- filed with one member state's customs authority -- extends detention requests across all (or a chosen subset of) EU member states, avoiding separate filings in each country.

### Covers trade marks, designs, copyright, and more

The regulation covers goods suspected of infringing trade marks, registered and unregistered designs, copyright, and geographical indications.

### Safety risk compounds the IP risk

Counterfeit electronics routinely fail basic safety testing. When these carry your branding, customers can attribute safety incidents to your company even though you never made the product.

## How the Application for Action process works

01

The rights holder files an AFA with a chosen member state, specifying national or Union-wide scope, and provides evidence of registered IP rights.

02

Once granted, the AFA is valid for a defined period (commonly up to one year, renewable).

03

When a shipment is detained, the rights holder is notified and generally has a short statutory window (often ten working days, extendable) to confirm the goods are infringing.

04

Under the simplified procedure, if the importer does not object, the goods can be destroyed without a full court process.

05

If the importer disputes the detention, the matter proceeds to national civil or criminal proceedings.

## Building an EU-wide brand-protection program

### Union AFA vs. national AFA

A Union AFA is efficient for brands shipping across multiple EU entry points, but requires EU-wide rights such as an EU trade mark.

### Give customs specific, actionable reference material

Specific product images, security features, and authorised distributor lists let customs officers distinguish genuine goods from suspect shipments at speed.

### Renew and maintain the AFA actively

An AFA that has lapsed or references outdated product information loses much of its practical value.

## Frequently asked questions

### What is the difference between a national and a Union AFA?

A national AFA covers only the member state where it is filed. A Union AFA extends coverage across some or all EU member states from a single application, but requires EU-wide rights.

### Does filing an AFA cost anything?

No -- there is generally no fee to submit an Application for Action to EU customs authorities.

### How quickly must I respond once goods are detained?

The regulation sets a short statutory window -- commonly around ten working days for standard goods -- to confirm the goods are infringing and elect the simplified destruction procedure.

### Can EU customs detain goods just transiting through the EU?

Customs authorities can act on suspect goods under their control in certain transit and free-zone situations, subject to the goods' declared customs procedure.
