# EU Machinery Regulation 2023/1230

The Machinery Regulation replaces the Machinery Directive from January 2027. It adds cybersecurity as an essential requirement, addresses AI-driven machinery behaviour, and revises the list of high-risk categories needing Notified Body involvement.

## Key changes from the Machinery Directive

### Transition timeline

Machinery Regulation 2023/1230 entered into force in July 2023. It applies from January 20, 2027. Products CE marked under the Machinery Directive 2006/42/EC before that date can remain on the market.

### Cybersecurity now an essential requirement

For the first time, cybersecurity is an essential health and safety requirement for machinery. Connected machinery must be designed to prevent malicious interference that could create physical danger.

### AI and evolving systems

The Machinery Regulation explicitly addresses self-evolving machine behaviour driven by machine learning. Systems that change their behaviour post-deployment may need to demonstrate ongoing conformity.

### Digital instructions permitted

Instructions may be provided in digital form only (no paper copy required) in more circumstances — though paper must still be offered on request for consumer-facing machinery.

### Annex I high-risk categories updated

The list of machinery requiring Notified Body involvement (Annex I) has been revised. Some categories have been added or modified compared to the Directive's Annex IV.

## Selected essential health and safety requirements

§1.1

### General principles

Machinery must be designed and constructed so as to fulfil its function and can be operated, adjusted, and maintained without exposing persons to risk.

§1.3

### Protection against mechanical hazards

Covers stability, risk of break-up in service, risks due to falling or ejected objects, surfaces and edges, combined machinery, and risk from variations in operating conditions.

§1.5

### Protection against other hazards

Covers electricity, static electricity, energy supply other than electricity, errors in fitting, extreme temperatures, fire, explosion, noise, vibrations, and radiation.

§1.6

### Maintenance

Adjustment, maintenance, and cleaning must be possible with the machinery at a standstill. If this is not possible, protective measures must be in place.

§1.7

### Information and instructions

Machinery must carry markings, warnings, and instructions including all information necessary for safe use in installation, operation, adjustment, and maintenance.

## Frequently asked questions

### Does my product need a Notified Body under the Machinery Regulation?

Most machinery can self-certify under Module A when harmonised standards fully cover the essential requirements. Annex I machinery — which includes specific high-risk categories like presses, woodworking machines, explosives-handling equipment, and machinery for lifting persons — requires Notified Body involvement.

### Can I still use the Machinery Directive until January 2027?

Yes. The Machinery Directive 2006/42/EC continues to apply until January 19, 2027. Products CE marked under the Directive before that date can remain on the EU market. From January 20, 2027, all new machinery placed on the EU market must comply with the Machinery Regulation.

### What harmonised standards apply under the new Machinery Regulation?

The Commission is in the process of mandating updated EN standards under the Machinery Regulation. Many existing EN ISO and EN standards under the Machinery Directive will transition with amendments. Check the Official Journal for the current list of standards cited under Regulation 2023/1230.

### Does the Machinery Regulation apply to software?

The Machinery Regulation explicitly covers safety-related control systems and addresses machinery where AI or self-learning software can alter machine behaviour. Pure software is not in scope unless it is placed on the market together with machinery as a safety function.
