# EU Market Surveillance: CE Marking Enforcement

Market surveillance is how the EU ensures that CE marking means something in practice. National MSAs test products, request technical files, halt imports at borders, and coordinate across the EU via ICSMS and Safety Gate. A technically compliant product with a defensible technical file survives surveillance; a CE mark without substance does not.

## How MSAs enforce CE marking compliance

### Product sampling and testing

MSAs purchase or requisition products from market and submit them to accredited laboratories for testing against CE marking requirements. Failed tests trigger formal non-compliance proceedings against the economic operator.

### Technical documentation requests

MSAs can require manufacturers or their authorised representatives to provide the complete technical file within 10 working days (or shorter in urgent cases). Inability to produce a compliant technical file is itself a non-compliance.

### Border customs controls

Under Regulation (EU) 2019/1020, customs authorities cooperate with MSAs to suspend release of products for third-country imports where compliance is in doubt. Products can be held at the EU border pending compliance verification.

### Formal non-compliance decisions

MSAs issue formal decisions requiring economic operators to take corrective action — including withdrawal, recall, labelling correction, or prohibition of supply. These are legally binding with defined timelines.

### Safety Gate (RAPEX) notifications

Serious risk products are notified through Safety Gate, creating a rapid alert visible to all EU member states. Cross-border coordination ensures non-compliant products cannot simply be redirected from one market to another.

### ICSMS (Information and Communication System for Market Surveillance)

EU-wide database where MSAs share market surveillance information, test results, and product non-compliance records. Economic operators and product histories are tracked across member state boundaries.

## Key MSAs in major EU markets

Germany

Netherlands

NVWA (Netherlands Food and Consumer Product Safety Authority) — general product safety; RDI (Radiocommunications Agency) — radio

Sweden

Konsumentverket (Swedish Consumer Agency) — consumer products; PTS (Post and Telecom Authority) — radio

Poland

UOKiK (Office of Competition and Consumer Protection) — consumer product safety

## Consequences of non-compliance

Mandatory withdrawal from sale pending compliance verification

Mandatory recall from consumers for serious safety risks

Prohibition on placing on the market — affecting all EU markets via ICSMS cross-border coordination

Financial penalties — amounts set by national law; significant penalties in major markets (Germany, France, Netherlands)

Under CRA (from December 2027): fines up to €15 million or 2.5% of global annual turnover for non-compliant connected products

Criminal liability in some jurisdictions for deliberate or negligent CE marking without compliance basis

Reputational damage — Safety Gate product alerts are publicly visible and searchable

## Frequently asked questions

### Can EU market surveillance authorities test products that are already CE marked?

Yes. CE marking is a manufacturer's declaration, not a government approval. MSAs have the authority and obligation to test CE-marked products to verify that the CE marking is supported by genuine compliance. A CE mark alone does not prevent surveillance or enforcement action. If testing reveals non-conformity, the MSA can require corrective action regardless of the presence of the CE mark.

### What is the difference between ICSMS and Safety Gate?

ICSMS (Information and Communication System for Market Surveillance) is a shared database used by EU MSAs to record and share market surveillance activities, test results, and non-compliance cases. Access is primarily for MSA professionals. Safety Gate (formerly RAPEX) is a rapid alert system specifically for products presenting a serious risk — notifications are publicly accessible on the Safety Gate website and trigger coordinated action across all EU member states within 24–48 hours.

### If my product is stopped at EU customs, what happens?

Customs authorities can suspend release for up to 4 working days (extendable by national authorities) while they check compliance. They may request the technical documentation, Declaration of Conformity, and labelling information. If compliance cannot be confirmed within the suspension period and the MSA determines there is a risk, the goods can be held pending formal investigation. The importer or the manufacturer's authorised representative is the primary contact during customs holds.

### How are online marketplace products enforced under market surveillance?

Regulation (EU) 2019/1020 extended market surveillance obligations to online marketplace operators. Platforms like Amazon, eBay, and AliExpress are required to cooperate with MSAs, remove non-compliant product listings, and block sellers who have been subject to enforcement actions. GPSR 2023/988 strengthened these obligations further, requiring platforms to have dedicated safety contacts and act on MSA instructions promptly.
