# EU Refurbished Electronics Compliance

Refurbishing and reselling electronics is a growing business across the EU, but the compliance obligations differ from selling a new product -- and differ again depending on whether you're reselling a product unchanged or substantially modifying it before resale.

Key question

Was the product substantially modified?

If substantially modified

Refurbisher can become the new "manufacturer"

Warranty

Statutory legal guarantee applies to refurbisher's sale

WEEE

Refurbisher registration may be required

CE re-marking

Only needed if original conformity is affected

## When refurbishment triggers new manufacturer obligations

### The "substantial modification" test

A party that substantially modifies a product in a way affecting compliance with essential requirements can be treated as the manufacturer of a "new" product, per Blue Guide interpretation of EU product legislation.

### Routine refurbishment generally does not reset obligations

Cleaning, cosmetic restoration, and standard repair generally do not trigger new-manufacturer status -- the original CE marking and technical file typically remain valid.

### Component substitution is the highest-risk area

Replacing a component with a non-equivalent part -- especially one affecting electrical safety, EMC, or radio characteristics -- is the most common way a refurbisher unintentionally crosses into new-manufacturer territory.

## Warranty and WEEE obligations for refurbishers

### The statutory legal guarantee still applies

A refurbisher selling to an EU consumer generally must honour the statutory legal guarantee -- though some member states allow a shorter period for used goods.

### WEEE producer registration can shift to the refurbisher

Where substantial modification occurs, or the refurbisher imports from outside the EU, WEEE producer registration and end-of-life financing obligations can attach to the refurbisher.

### Clear disclosure to consumers matters

Consumer protection law generally expects clear disclosure that a product is refurbished rather than new, plus accurate description of its condition.

## Assessing compliance obligations before refurbishing

01

Determine whether your refurbishment involves component substitution that could affect conformity with essential requirements.

02

Where modification is limited to routine repair, retain the original technical documentation as your compliance basis.

03

Where modification is substantial, prepare your own conformity assessment, technical file, and declaration of conformity.

04

Check national-level guarantee rules for used goods in your target member states.

05

Confirm whether your activity requires its own WEEE producer registration.

## Frequently asked questions

### Do I need to re-CE-mark a device I'm just cleaning and reselling?

Generally no -- routine refurbishment that doesn't affect compliance with essential requirements typically does not require new CE marking or a new technical file.

### What kind of modification turns a refurbisher into a "manufacturer" under EU law?

A modification affecting compliance with essential safety, EMC, or radio requirements can shift manufacturer-level obligations onto the refurbisher.

### Does the standard two-year legal guarantee apply to refurbished electronics?

Generally yes, though several EU member states allow a shorter statutory guarantee period specifically for used goods.

### Who is responsible for WEEE end-of-life obligations on a refurbished device?

It depends on the refurbisher's role -- if acting as a new economic operator, WEEE obligations can attach to the refurbisher rather than the original manufacturer.
