# Hong Kong Product Compliance Overview

Hong Kong doesn't run a single unified compliance mark. Instead, five regulators each own a slice of the product landscape — OFCA for radio/telecom, EMSD for electrical safety and energy, the Medical Device Division for medical products, the Centre for Food Safety for food, and Customs and Excise for import — and most regimes lean toward voluntary or supplier-declared compliance rather than mandatory third-party certification, except for a handful of specifically named higher-risk categories.

## The regulators you'll deal with

### OFCA — Office of the Communications Authority

Regulates radio and telecom equipment. Products fall into one of three regimes — licence-exempt, Class Licence, or individually licensed — rather than a single blanket licensing requirement, and this determines whether you need certification at all.

### EMSD — Electrical and Mechanical Services Department

Regulates electrical product safety under the Electrical Products (Safety) Regulation, plus energy efficiency labelling. Only six 'prescribed products' need mandatory third-party certification; most electrical products rely on a supplier's declaration.

### MDD — Medical Device Division, Department of Health

Administers the Medical Device Administrative Control System (MDACS) — currently a voluntary/administrative listing regime, not yet statutory. A 2026 legislative proposal will introduce statutory registration alongside a new Centre for Medical Products Regulation.

### CFS — Centre for Food Safety

Regulates food under the Public Health and Municipal Services Ordinance (Cap. 132) and the Food Safety Ordinance (Cap. 612), which layers importer/distributor registration and traceability on top of general food safety and labelling rules.

### Customs and Excise Department

Administers import declarations and general customs clearance, checking for sector-specific approvals (OFCA, EMSD, MDD, CFS) as applicable before releasing restricted goods.

## How to route a product through Hong Kong compliance

01

Classify the product first: does it have a radio function, is it an electrical product, a medical device, food, or general merchandise with no sector-specific regime?

02

For radio/telecom products, check licence-exempt status before assuming OFCA licensing is required — Bluetooth, RFID, and 2.4/5 GHz Wi-Fi are licence-exempt; UWB, generic short-range devices, and 6 GHz Wi-Fi need a Class Licence; only apparatus outside these categories needs individual licensing.

03

For electrical products, determine whether it's one of the six 'prescribed products' (plugs, adaptors, lampholders, flexible cords, extension units, unvented thermal storage water heaters) requiring mandatory RCB certification, or a non-prescribed product where a supplier's declaration suffices.

04

For medical devices, treat MDACS listing as voluntary today, but plan for the 2026 statutory transition — early voluntary listing positions you ahead of the mandatory regime.

05

For food, register under Cap. 612's importer/distributor traceability scheme in addition to meeting Cap. 132 composition and labelling rules.

06

Clear Customs and Excise Department import declarations, with sector approval evidence ready for any restricted-goods inspection.

## Frequently asked questions

### Is there a single 'Hong Kong compliance mark' like CE or UKCA?

No. Hong Kong doesn't use a unified conformity mark. Radio equipment certification via OFCA-recognized bodies is largely voluntary, EMSD certification is mandatory only for six specific 'prescribed' electrical products, and medical devices go through voluntary MDACS listing. Compliance is regime-by-regime rather than one universal mark.

### What's changing with Hong Kong medical device regulation in 2026?

The Hong Kong Government confirmed via its 2025 Policy Address that a legislative proposal to statutorily regulate medical devices will go to the Legislative Council in 2026, alongside establishing the Hong Kong Centre for Medical Products Regulation (CMPR). Until that passes, MDACS listing remains voluntary/administrative, though public reporting suggests DH-procured devices may face earlier mandatory listing.

### Do FCC or CE test reports work for OFCA equipment evaluation?

Yes, in many cases. OFCA's Recognised Agencies framework explicitly accepts FCC-designated Telecommunication Certification Bodies (TCBs), EU Notified Bodies, and IEC CB Scheme labs as recognized evaluation routes — not just Hong Kong-local labs — provided the test scope matches OFCA's requirements.

### Is a food-contact-material regulation in force in Hong Kong?

Not a comprehensive one. The Centre for Food Safety has published targeted risk-assessment studies for specific materials — baby bottles, melamine-ware, plastic takeaway containers — but no single official source establishes a general, mandatory food-contact-materials migration-limit regulation comparable to the EU or US. Treat this as a genuine regulatory gap rather than assuming a blanket rule exists.

**Disclaimer:** Educational resource only. Regulatory requirements change and vary by product category. Consult an accredited test laboratory or qualified compliance engineer before making certification decisions.
