# Hong Kong Electrical Products Safety: Cap 406G Compliance

The Electrical Products (Safety) Regulation (Cap 406G) requires companies selling regulated electrical products in Hong Kong to register as approved suppliers with EMSD and demonstrate compliance with prescribed safety standards. The regulation covers household appliances, AV equipment, luminaires, and power supplies — with criminal penalties for non-compliant products reaching the market.

## Key requirements

### Cap 406G scope and EMSD enforcement

The Electrical Products (Safety) Regulation (Cap 406G) under the Electrical Ordinance requires that regulated electrical products sold in Hong Kong comply with prescribed safety standards and carry the approved supplier's registration. The Electrical and Mechanical Services Department (EMSD) enforces the regulation through market surveillance, inspections, and product testing.

### Approved supplier registration

Companies selling regulated electrical products in Hong Kong must register as an approved supplier with EMSD. Registration ties the company to specific product models and requires a commitment to maintain compliance with applicable standards — it is not a product certification scheme but a supplier accountability mechanism.

### Applicable safety standards

Cap 406G references IEC and EN-based standards adopted by Hong Kong. Products must meet the electrical safety standards specified for their category — typically IEC 60335 series for household appliances, IEC 60065 for audio/video equipment (being superseded by IEC 62368-1), and similar. Test reports from HOKLAS or ILAC-accredited laboratories support compliance.

### Safety mark and labelling

Approved suppliers may use the EMSD safety mark on compliant products. In addition to the safety mark, products must carry adequate labelling including rated voltage, rated current or power, and safety warnings — in English and Chinese for Hong Kong retail products. The approved supplier's registration number is typically included in the labelling.

## Compliance process

01

Identify whether your product falls within the regulated electrical product categories under Cap 406G — EMSD publishes the list of regulated product types including household appliances, lighting equipment, and AV products.

02

Obtain test reports from a HOKLAS-accredited or ILAC-accredited laboratory demonstrating compliance with the applicable Hong Kong safety standards for your product category.

03

Register as an approved supplier with EMSD, submitting company details, product specifications, and compliance evidence (test reports and technical documentation).

04

Receive your approved supplier registration number, which must be referenced in product labelling for regulated products sold in Hong Kong.

05

Apply safety mark and all required labelling to product and packaging before sale or import into Hong Kong.

06

Maintain compliance documentation and notify EMSD of significant product changes — design modifications affecting safety characteristics may require updated test reports and registration amendment.

07

Respond to any EMSD market surveillance enquiries promptly and retain all compliance records for the regulatory period — EMSD can inspect, test, and require recall of non-compliant products.

## Frequently asked questions

### Which product categories are regulated under Cap 406G?

EMSD regulates a range of categories including household electrical appliances (fans, heaters, cooking appliances, washing machines), luminaires and lamps, audio and video equipment, power supplies and adaptors, and extension cords. The full list is in the Schedule to Cap 406G. Products not in the schedule are not subject to the approved supplier requirement but still cannot be unsafe under general consumer protection law.

### Does CE marking satisfy Hong Kong electrical safety requirements?

Not automatically. CE marking demonstrates conformity with EU directives, and the underlying test reports (e.g., against IEC standards that Hong Kong also references) can often be reused. However, CE marking itself has no legal standing under Cap 406G — you still need to register as an approved supplier with EMSD and confirm the test scope covers Hong Kong's applicable standards.

### What are the penalties for non-compliance?

Under Cap 406G, selling regulated electrical products without approved supplier registration or without meeting safety requirements is a criminal offence. Penalties include fines and, for persistent or serious offences, imprisonment. EMSD can also issue orders to stop sale, seize goods, and publicise enforcement actions — making market surveillance exposure a significant commercial risk.

### Do I need a Hong Kong entity to register as an approved supplier?

EMSD approved supplier registration is available to companies incorporated in Hong Kong or operating through a Hong Kong-registered entity. Foreign manufacturers typically work through their Hong Kong importer or a local authorised representative who holds the approved supplier registration and takes legal responsibility for compliance.

**Disclaimer:** Educational resource only. Regulatory requirements change and vary by product category. Consult EMSD or a qualified compliance engineer before making certification decisions for the Hong Kong market.
