# Hong Kong Trade Mark Registration and IP Protection for Hardware Brands

Hong Kong is both a major consumer electronics market and a global re-export hub — making trade mark registration and Customs recordal essential for hardware brands that want control over how their products enter the market and what counterfeits get stopped at the border.

## IP protection tools for hardware companies in Hong Kong

### Hong Kong trade mark registration

Trade marks are registered with the Trade Marks Registry (Intellectual Property Department) under the Trade Marks Ordinance (Cap. 559). Registration gives exclusive rights to use the mark in Hong Kong — entirely separate from mainland China, which requires its own CNIPA filing. Class 9 covers electronics, computers, software, and measuring instruments. Registration is valid for 10 years and renewable indefinitely.

### Registration process and timeline

Hong Kong operates an examination system — applications are examined for absolute grounds (descriptiveness, lack of distinctiveness) and relative grounds (conflict with earlier registered marks). The process typically takes 12–18 months from filing to registration under normal circumstances. Applications are published in the Trade Marks Journal for a three-month opposition period before registration is granted.

### Customs recordal for border protection

Registered trade mark owners can apply to record their mark with the Customs and Excise Department under the Trade Descriptions Ordinance (Cap. 362). Once recorded, Customs detains suspected infringing goods at the Hong Kong border pending investigation. The brand owner is notified and given the opportunity to inspect the detained goods and confirm whether they are counterfeits.

### Copyright protection for hardware products

Circuit board layouts, product industrial designs, and software embedded in electronics products may be protected by copyright under the Copyright Ordinance (Cap. 528) without registration. Copyright arises automatically on creation. Hardware companies should document creation dates, authorship, and version history to establish priority if a dispute arises over copied designs or firmware.

## How to register and enforce trade marks in Hong Kong

01

Search the Hong Kong Trade Marks Registry database at ipd.gov.hk to confirm the mark is available in Class 9 and any other relevant classes for your hardware products — a conflicting earlier registration is the most common obstacle to registration.

02

File a trade mark application with the Trade Marks Registry via the IPD e-filing portal — include a clear representation of the mark, the Nice Classification classes and goods/services specification, and the applicant's details.

03

Respond to any examination report from the Registry — absolute grounds objections (e.g. the mark is descriptive of the goods) and relative grounds (conflict with an earlier mark) are common; a well-drafted response or evidence of acquired distinctiveness can overcome many objections.

04

Once registration is confirmed, apply for customs recordal with the Customs and Excise Department — provide the registration certificate, high-resolution photographs of genuine products, and guidance materials to help Customs officers identify counterfeits.

05

Monitor the Hong Kong market through authorised distributors and engage the IPD's IP Border Enforcement Programme if coordinated seizure of suspected counterfeit shipments is needed — the programme coordinates between brand owners and Customs for targeted enforcement operations.

## Frequently asked questions

### Is Hong Kong trade mark registration separate from mainland China?

Yes. Hong Kong and mainland China operate entirely separate trade mark systems. A Hong Kong trade mark registered with the Trade Marks Registry (Intellectual Property Department) gives rights only in Hong Kong — it has no effect in mainland China. For mainland protection, a separate application must be filed with the China National Intellectual Property Administration (CNIPA). Brands active across both jurisdictions typically file in both systems simultaneously.

### What is covered by a Class 9 trade mark in Hong Kong?

Class 9 under the Nice Classification covers scientific, nautical, surveying, photographic, cinematographic, optical, weighing, measuring, signalling, checking (supervision), life-saving, and teaching apparatus and instruments; apparatus and instruments for conducting, switching, transforming, accumulating, regulating or controlling electricity; computers, computer software, mobile phones, tablets, and electronic devices. For hardware brands, Class 9 is the primary class, but Class 42 (technology services) and other classes may be relevant depending on the business model.

### How does Customs border enforcement work for trade marks in Hong Kong?

After recording a trade mark with the Customs and Excise Department, Customs officers at Hong Kong ports and borders are authorised to detain shipments suspected of bearing infringing marks. The brand owner is notified and given a window to inspect the goods and confirm infringement. If confirmed, Customs can seize the goods and refer the matter for prosecution under the Trade Descriptions Ordinance. The programme is proactive — Customs can act on their own initiative, not only on brand owner tip-offs.

### Can copyright protect electronics hardware designs without registration?

Yes. Copyright in Hong Kong arises automatically on the creation of an original work — no registration is required. Circuit board layouts, product enclosure designs, firmware and software, and technical drawings can all attract copyright protection under Cap. 528. The practical challenge is proving the creation date and authorship in a dispute. Hardware companies should maintain version-controlled design files, dated commit logs, and internal documentation that establishes when and by whom each design element was created.
