# DPIIT Startup India Recognition: Tax and IP Benefits for Hardware Startups

DPIIT Startup India recognition unlocks a stack of benefits for eligible hardware and electronics startups: a 100% income tax deduction for 3 years under Section 80-IAC, angel tax exemption for equity raises above fair market value, expedited and discounted patent examination, and government procurement preferences. The application is self-certified and typically processed in 2–3 days — it should be the first thing any sub-10-year-old hardware startup incorporated in India does.

## DPIIT recognition benefits for hardware startups

### What is DPIIT Startup India recognition?

DPIIT (Department for Promotion of Industry and Internal Trade) Startup India recognition is a government certification that unlocks a set of fiscal and regulatory benefits for eligible startups in India. An entity is recognised as a startup if it is incorporated as a private limited company, registered partnership, or LLP; is less than 10 years old from the date of incorporation; has annual turnover not exceeding INR 100 crore in any prior financial year; and is working towards innovation, development, or improvement of products or processes, or is a scalable business model with high potential for employment generation or wealth creation.

### Tax benefits under Section 80-IAC

DPIIT-recognised startups are eligible to apply for a 100% income tax deduction on profits for any 3 consecutive years out of the first 10 years of operation under Section 80-IAC of the Income Tax Act. The deduction requires a separate certification from the Inter-Ministerial Board of Certification (IMBC) — DPIIT recognition alone is not sufficient for the 80-IAC deduction. For hardware startups investing heavily in early product development, the 80-IAC benefit can significantly reduce the tax liability in the years when the company first turns profitable.

### Angel tax exemption

DPIIT-recognised startups are exempt from angel tax (Section 56(2)(viib) of the Income Tax Act), which historically taxed any share issuance to investors above fair market value as 'income from other sources'. Angel tax was a significant concern for early-stage hardware startups raising equity at valuations exceeding book value — the exemption removes this friction for DPIIT-recognised entities. The exemption applies to investments from both resident and non-resident investors, following 2023 amendments.

### Fast-track IP facilitation and regulatory sandbox

DPIIT-recognised startups can access fast-track patent examination under the National Intellectual Property Rights Policy — patent applications from startups are examined on an expedited timeline (typically within 30 days of filing a request for examination, versus the standard queue). Startups also receive an 80% rebate on patent filing fees and a 50% rebate on trademark filing fees. The Startup India portal also facilitates access to the SEBI regulatory sandbox, RBI innovation hub, and other regulatory experiments relevant to fintech and connected hardware.

## How to apply and use DPIIT recognition

01

Register your company as a private limited company, LLP, or registered partnership in India — DPIIT recognition is available to these entity types incorporated in India within the last 10 years.

02

Apply for DPIIT Startup India recognition through the Startup India portal (startupindia.gov.in) — the application is self-certified and requires: entity registration documents, a description of your innovation (product or process), and confirmation that annual turnover has not exceeded INR 100 crore.

03

After receiving DPIIT recognition, if you want the Section 80-IAC income tax deduction, apply separately to the Inter-Ministerial Board of Certification (IMBC) — this requires a more detailed review of your innovation and scalability claims.

04

File for expedited patent examination after receiving DPIIT recognition — submit Form 18A (request for examination) along with your patent application and claim the startup fee rebate (80% reduction) and expedited queue placement.

05

Explore PLI (Production Linked Incentive) scheme eligibility: hardware and electronics startups may be eligible for PLI incentives under the IT Hardware PLI scheme (covering laptops, tablets, servers) and the Component PLI scheme — PLI is separate from Startup India recognition but the two can be pursued in parallel.

06

Use DPIIT recognition to access government procurement preferences: the GeM (Government e-Marketplace) portal provides startups with preferential access to government contracts and a simplified bidding process for DPIIT-recognised entities.

07

Maintain your startup status: turnover must remain below INR 100 crore in each financial year and the entity must remain within 10 years of incorporation — if either threshold is crossed, startup status and associated benefits lapse.

## Frequently asked questions

### Can hardware manufacturing companies qualify as startups under DPIIT criteria?

Yes — hardware and electronics companies qualify for DPIIT startup recognition provided they meet the criteria: under 10 years old, turnover under INR 100 crore, and working on innovation in products or processes. A company manufacturing an innovative hardware product, developing a new IoT device category, or applying novel manufacturing processes can qualify. The innovation criterion is interpreted broadly — 'improvement of products or processes' covers most genuine product development activity in hardware.

### What is the PLI scheme for IT hardware and how does it interact with Startup India?

The PLI (Production Linked Incentive) scheme for IT Hardware provides financial incentives (typically 1–4% of incremental net sales above a base year) for manufacturers of laptops, tablets, all-in-one PCs, and servers made in India. PLI is administered by MeitY and has separate eligibility criteria (minimum investment thresholds, domestic value addition targets). A DPIIT-recognised startup can simultaneously participate in PLI — the two are independent government programmes. PLI is targeted at manufacturers with the ability to invest significantly in production capacity.

### Does the angel tax exemption require any ongoing reporting?

The angel tax exemption for DPIIT-recognised startups applies to share issuances above fair market value — it removes the income tax liability on the premium. There is no specific ongoing reporting requirement for the exemption, but the startup must maintain its DPIIT recognition status. If the startup's DPIIT recognition lapses (turnover exceeds INR 100 crore or it passes 10 years), subsequent share issuances may no longer be covered by the exemption.

### How long does DPIIT recognition take to process?

DPIIT Startup India recognition is typically processed within 2–3 business days for applications that are complete and meet the eligibility criteria — the application is self-certified, so there is no detailed government review of the innovation claim for the basic recognition. The IMBC certification for Section 80-IAC income tax benefit takes significantly longer (weeks to months) as it involves a substantive review. Expedited patent examination timelines depend on the patent type and current queue.

**Disclaimer:** Educational resource only. Tax benefits require separate IMBC certification; eligibility criteria and benefit terms may change with Finance Act amendments. Consult a qualified Indian tax adviser or CA before relying on DPIIT benefits in financial planning.
