# Selling on Amazon India and Flipkart: Compliance for Foreign Brands

Indian e-commerce platforms are not compliance bypasses — Amazon India and Flipkart actively enforce BIS registration, MRP labeling, country of origin declaration, and EPR requirements. A product that passes customs is still at risk of ASIN suspension if compliance documentation expires or is found missing during platform audits.

## Key platform compliance requirements

### BIS CRS / ISI Mark registration

Amazon India and Flipkart

For products covered under BIS compulsory registration scheme, sellers must provide BIS registration number at listing. Platforms conduct periodic audits and delist products that cannot produce valid CRS certificates. The BIS R-Number must appear on the product label.

### MRP on every product unit

Both platforms

Every individual product unit sold must carry MRP in Indian Rupees inclusive of all taxes. Platforms cannot list products at prices above the declared MRP. MRP must be visibly printed on or affixed to the product or its immediate packaging.

### Importer details on label

Both platforms

Products imported from overseas must have Indian importer's name, address, and contact on the product label. Generic 'Imported by: \[distributor\]' labels are acceptable only if the distributor is the actual importer of record.

### Country of origin declaration

Both platforms (mandatory since 2020)

Country of origin must be declared on every product page and on the physical product label. India's Consumer Protection (E-Commerce) Rules 2020 made this mandatory for all online listings. 'Made in China', 'Made in Germany' etc. must be visible to buyer.

### EPR registration for electronics sellers

Amazon India (required for electronics FBA)

Electronics sellers using Amazon FBA (Fulfilled by Amazon) may be required to provide CPCB EPR authorization number. Flipkart has similar EPR compliance expectations for its marketplace sellers.

### FSSAI license number (food/nutrition products)

Both platforms

Food, dietary supplements, and nutrition products sold on Indian e-commerce platforms must carry FSSAI license/registration number. Platforms verify and delist non-compliant food product listings.

## Common pitfalls for foreign sellers

Listing products on Amazon/Flipkart before obtaining BIS CRS registration — platforms verify registration numbers and delist non-compliant SKUs

Using the same product listing as international Amazon stores without updating MRP, labeling, and compliance data for India

Incorrect importer details — listing manufacturer's overseas address instead of Indian importer/entity address

Missing country of origin on product page — required by Consumer Protection (E-Commerce) Rules 2020

Not updating listings when BIS CRS expires (2-year validity) — expired certificates lead to delisting

Ignoring EPR requirements — Amazon India is increasingly enforcing EPR authorization for electronics sellers

## Cross-border e-commerce considerations

### Direct B2C cross-border shipping

India does not have a formal simplified customs duty exemption for low-value B2C e-commerce imports (unlike some countries). Products shipped directly from overseas to Indian consumers are subject to full customs duty and import compliance requirements. This makes pure cross-border DTC challenging at scale.

### Amazon Global Store

Amazon's Global Store enables international sellers to list on Amazon.in with Amazon handling some import logistics. However, BIS, WPC, and other Indian compliance requirements still apply. Products without required certifications cannot be listed even through Global Store.

### Meesho, Myntra, and other platforms

Meesho, Myntra, and Nykaa have similar compliance enforcement for product categories under BIS, FSSAI, and other mandatory schemes. Compliance requirements are product-category specific and platform policies continue to tighten as government enforcement increases.

## Frequently asked questions

### Can I sell on Amazon India directly from overseas without an Indian entity?

For most physical goods requiring BIS CRS or other Indian regulatory approvals, selling without an Indian entity is practically very difficult. The certifications (BIS CRS, WPC ETA) require an Indian Authorized Indian Representative (AIR). The AIR effectively becomes your India entity for regulatory purposes. You can sell through a distributor or third-party AIR without setting up your own Indian company — but some Indian entity must be the importer of record and hold the compliance certifications.

### What happens if Amazon India finds my BIS certificate has expired?

Amazon India periodically requests compliance documentation from sellers. If your BIS CRS certificate has expired (2-year validity), Amazon can suspend the ASIN (product listing) until you provide a renewed certificate. During the suspension, you cannot sell that product. This can happen without warning. The safest approach is to track BIS CRS renewal dates and renew at least 2–3 months before expiry.

### My product is manufactured in China and sold under my brand. Who needs the BIS CRS — me or the Chinese manufacturer?

The BIS CRS registration obligation rests with the entity placing the product on the Indian market — which is you as the brand owner/importer. For foreign manufacturers, BIS CRS requires an Authorized Indian Representative. Your Indian AIR applies for and holds the CRS registration on your behalf, with the Chinese factory details included in the application. The product carries your brand and the Standard Mark with your CRS R-Number.

**Disclaimer:** Platform compliance policies evolve frequently. Always verify current Amazon India and Flipkart seller requirements directly with the platform before listing products. Regulatory requirements underlying platform policies are set by BIS, CPCB, and other authorities.
