# India FTA Benefits for Technology Products: ASEAN, Korea, Japan, UAE

India's FTAs can significantly reduce customs duty for technology products manufactured in partner countries — but only if the product genuinely originates in the FTA country with real manufacturing or value addition. For electronics companies with manufacturing in Vietnam, Malaysia, or South Korea, FTA benefits can make India market entry substantially more viable economically.

## India's key FTAs relevant to technology products

### ASEAN-India FTA (AIFTA)

**Countries:** Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, Philippines, Singapore, Thailand, Vietnam

Since 2010

Vietnam and Malaysia are major electronics manufacturing hubs. Electronics assembled in ASEAN with AIFTA-compliant Rules of Origin can benefit from reduced BCD — important for products manufactured in Vietnam or Malaysia by global OEMs.

### India-Korea CEPA

**Countries:** South Korea

Since 2010

South Korea is a major source of semiconductors, display panels, and consumer electronics. Samsung and LG components and products can benefit from preferential duty under India-Korea CEPA if Rules of Origin are met.

### India-Japan CEPA

**Countries:** Japan

Since 2011

Japanese industrial electronics, machinery, and precision instruments. CEPA reduces BCD on many Chapter 84 and 85 products from Japan. Relevant for industrial equipment and precision instruments of Japanese origin.

### India-UAE CEPA

**Countries:** United Arab Emirates

Since 2022 (most recent)

UAE CEPA is newer and covers a wide range of products. Electronics traded through UAE as an entrepôt hub may benefit, but Rules of Origin must confirm UAE origin — transshipment without value addition does not confer UAE origin.

### India-Australia ECTA

**Countries:** Australia

Since 2022

Limited direct electronics manufacturing in Australia, but covers goods of Australian origin. Relevant for specialized scientific instruments and resource-sector equipment from Australia.

## Rules of Origin criteria for FTA claims

### Change in Tariff Classification (CTC)

The exported product must have a different HS code from the imported inputs at a specified level (chapter, heading, or sub-heading). If electronics are assembled in Vietnam from Chinese components with sufficient CTC, they can achieve Vietnam origin under AIFTA.

Most commonly used for electronics; specifics vary by HS heading

### Regional Value Content (RVC)

A minimum percentage (typically 35–40%) of the product's value must be added in the FTA member country. For ASEAN: 40% ASEAN content (ASEAN cumulation applies — materials from any ASEAN member count).

Used as alternative or in conjunction with CTC; cumulation rules vary by FTA

### Specific Process Rule

Certain products have specific manufacturing processes that must occur in the FTA country to qualify. Less common for electronics but may apply to specific HS categories.

Check specific product schedules in each FTA

### De Minimis / Tolerance

Non-originating materials below a threshold (typically 10% of ex-works price) can be overlooked for CTC purposes. Allows minor imported components without affecting origin determination.

Useful for electronics with small value non-originating accessories

## How to claim FTA duty concession at Indian customs

01

### Verify your product qualifies for FTA duty concession

Check the specific FTA tariff schedule for your HS code. Not all products get zero duty — many have phased reductions. Some sensitive products may be excluded from FTA concessions.

02

### Confirm Rules of Origin compliance

Ensure your product meets the applicable Rules of Origin (CTC, RVC, or specific process) for the FTA. Maintain supporting documentation: bill of materials, supplier declarations, value addition calculations.

03

### Obtain Certificate of Origin from authorized body

Get a Form E (ASEAN), Form CEPA-Korea, Form JCEPA (Japan), or UAE CEPA Certificate of Origin from the exporting country's authorized issuing body. For ASEAN: ASEAN Customs Division or designated chambers of commerce.

04

### Present COO at Indian customs

Submit the Certificate of Origin with the Bill of Entry at Indian customs. Customs officer verifies COO authenticity and Rules of Origin compliance before granting preferential duty rate.

## Frequently asked questions

### Does ASEAN FTA help reduce customs duty on electronics assembled in Vietnam?

Yes — for electronics manufactured in Vietnam that meet AIFTA Rules of Origin (typically 40% ASEAN Regional Value Content or Change in Tariff Classification), preferential duty rates apply under AIFTA. Many global electronics OEMs manufacturing in Vietnam (smartphones, laptops, electronics components) can claim AIFTA benefits for India-bound exports. The key is demonstrating the product genuinely originates in Vietnam through value addition, not mere transshipment or packaging in Vietnam.

### Can a company in India use the India-UAE CEPA to import Chinese electronics via UAE at lower duty?

No — products must genuinely originate in UAE to qualify for India-UAE CEPA preferential rates. Simply routing Chinese goods through UAE without meaningful value addition does not confer UAE origin. This is called transshipment or tariff shopping and is a customs violation. UAE CEPA Rules of Origin require actual manufacturing or substantial transformation in UAE. The practice of routing goods through FTA countries to gain preferential rates is actively monitored and penalized by Indian customs.

### What is the ITA-1 agreement and how does it relate to FTAs?

The ITA-1 (Information Technology Agreement) is a WTO multilateral agreement — separate from bilateral FTAs. Under ITA-1, India committed to zero customs duty on a specific list of IT products regardless of their country of origin. This means ITA-1 zero-duty applies to computers, semiconductors, and certain telecom equipment from any country — no FTA or Certificate of Origin needed. ITA-1 zero-duty is often more valuable than FTA concessions for covered products since it applies universally.
