# India Legal Metrology Act: MRP, Packaged Goods, and Compliance for Foreign Brands

India's Legal Metrology Act 2009 and Packaged Commodities Rules 2011 are among the most specific and strictly enforced labelling laws for consumer products in the world. Any pre-packaged goods sold in India — including electronics, hardware, and accessories — must carry mandatory label declarations in a specific format and size.

What the Act covers

## Scope of the Legal Metrology Act for hardware companies

The Legal Metrology Act 2009 governs weights, measures, and pre-packaged commodities in India. For hardware and electronics companies, the most relevant provision is the Packaged Commodities Rules (PCR) 2011, which govern mandatory labelling on pre-packaged goods. A pre-packaged commodity is any commodity packed or placed in a package to be sold — which covers virtually all retail consumer electronics sold in India. The Rules apply regardless of whether goods are manufactured in India or imported.

Required declarations under PCR 2011: name and address of the manufacturer, packer, or importer; name of the commodity and net quantity or number of units in metric units; month and year of manufacture or packing; Maximum Retail Price (MRP) inclusive of all taxes; country of origin for imported goods; and a customer care contact number or email address. All declarations must be in English and may additionally be in Hindi or other scheduled languages. Font size requirements are specified in the Rules — font below the minimum size is a violation even if the content is correct.

MRP requirements

## Understanding the Maximum Retail Price obligation

The MRP (Maximum Retail Price) is one of the most distinctive features of Indian retail regulation. MRP is the maximum price at which any retailer can sell the product to the end consumer, inclusive of all taxes and charges. No retailer can legally charge more than the declared MRP — doing so is a criminal offence under the Legal Metrology Act. MRP must appear on the label in the format: 'MRP Rs. \_\_\_\_\_ (inclusive of all taxes)' on the principal display panel of the packaging.

For foreign brands, setting the MRP requires advance consideration of the entire India market pricing strategy because the declared MRP is binding for all retail channels simultaneously. Unlike Western markets where pricing is retailer-determined, the manufacturer or importer declares a single maximum price that applies across all sales channels. Each SKU variant needs its own MRP declaration on its own packaging — MRP cannot cover a range of product sizes.

Registration and compliance

## Who must register and how

Manufacturers and importers of pre-packaged commodities in India must register as a packer or importer under the Packaged Commodities Rules. Registration is done at the state level with the Department of Legal Metrology in each state where the company has a registered presence. Foreign manufacturers who import into India typically do so through an Indian importer. The Indian importer registers under the Rules and their name and address must appear on the label.

The declaration 'Marketed by:' or 'Imported by:' followed by the Indian company's name and address satisfies the identity disclosure requirement. Enforcement by Legal Metrology Inspectors is routine in major cities. Products found with non-compliant labels can be seized and the importer prosecuted. Market surveillance at retail outlets is a regular enforcement activity, particularly in metro markets.

### What is the penalty for non-compliance with the Packaged Commodities Rules?

Penalties for first-time violations under the Legal Metrology Act range from Rs. 2,000 to Rs. 1,00,000 for most labelling violations. Repeat offenders face higher fines and potential imprisonment of up to two years. Products seized at retail can be compounded (a settlement fine) or destroyed. For imported goods, customs clearance can also be blocked pending label compliance.

### Can I use a sticker to add Legal Metrology information to imported products?

Yes. It is common practice to apply a label sticker or sleeve to imported electronics to add the required Indian legal declarations — including the importer's address, MRP, customer care details, and country of origin — without requiring the overseas manufacturer to change the base product packaging. The sticker must be permanent, legible, and not conceal any other required information.

### Does the MRP include customs duty and GST?

Yes. MRP must be 'inclusive of all taxes' — this means the retail selling price must include customs duty (BCD), IGST on import, and any other applicable taxes. The MRP is the final consumer price with no additional charges. Retailers cannot add taxes or handling charges on top of MRP.

### Does the Legal Metrology Act apply to e-commerce sales?

Yes. The Ministry of Consumer Affairs clarified that online sellers must display MRP and mandatory declarations on the product listing page before purchase. For goods sold through e-commerce and delivered to Indian consumers, the packaging must still carry all required physical labels. Online-only disclosure without physical labelling does not satisfy the Rules for delivered goods.
