# India Plastic Waste Management Rules for Hardware Packaging

Every hardware product shipped in India comes wrapped in plastic packaging of some kind -- and that packaging carries its own extended producer responsibility obligations under the Plastic Waste Management Rules, separate from and running alongside any e-waste EPR duties on the device itself.

## Why hardware companies need to look at packaging separately

### Two EPR obligations, not one

A hardware company can owe e-waste EPR obligations for the electronic device itself under the E-Waste (Management) Rules, and separately owe plastic packaging EPR obligations under the Plastic Waste Management Rules for the packaging that device ships in -- these are distinct registrations and reporting obligations.

### Packaging is categorized by type

The plastic packaging EPR framework categorizes packaging (rigid plastic, flexible plastic, multi-layered packaging, and others) with different recycling and reprocessing targets and, in some cases, minimum recycled-content expectations attached to each category.

### The rules have been amended periodically

The Plastic Waste Management framework, originally from 2016, has been amended multiple times, including provisions addressing single-use plastic items and EPR-specific guidelines -- checking the current consolidated rule text rather than the original 2016 baseline matters.

## Producer, importer, and brand owner obligations

### Who is obligated

The framework generally places EPR obligations on producers, importers, and brand owners (PIBOs) of plastic packaging -- a hardware company packaging its own product, or importing a product already packaged, can fall into one or more of these categories depending on its supply chain role.

### CPCB EPR Portal registration

Obligated entities register on the CPCB's centralized EPR portal, report the quantity and category of plastic packaging placed on the market, and demonstrate fulfillment of recycling/reprocessing targets, typically through EPR certificates obtained from registered recyclers or processors.

### Chemical-composition aspects also apply

Beyond quantity-based EPR targets, the Rules address chemical aspects of plastic packaging -- restrictions or conditions relevant to certain plastic types and additives -- which sits alongside, and separate from, the quantity-based EPR reporting obligation.

## Building a compliant packaging EPR program

01

Determine your role (producer, importer, or brand owner) for the specific packaging you place on the Indian market -- this determines who carries the primary EPR obligation.

02

Categorize your packaging by the plastic type categories used in the EPR framework, since targets and reporting differ by category.

03

Register on the CPCB EPR Portal and establish a process for tracking packaging quantities placed on the market each reporting period.

04

Engage registered recyclers or processors to obtain the EPR certificates needed to demonstrate target fulfillment.

05

Keep this program separate from, but coordinated with, any e-waste EPR obligations you carry for the device itself -- the two frameworks have different registration systems and reporting cycles.

## Frequently asked questions

### Is plastic packaging EPR the same as e-waste EPR for my electronics?

No -- they are separate frameworks with separate registration and reporting systems. A hardware company can owe e-waste EPR obligations for the device under the E-Waste Rules and plastic packaging EPR obligations for its box, cushioning, and wrap under the Plastic Waste Management Rules, simultaneously.

### Who counts as the "producer" of packaging if I import a fully packaged product?

Import status generally makes you the obligated party for the packaging that arrives with your imported product, similar to how import status triggers e-waste producer obligations -- confirm your specific role against the current rule definitions for producers, importers, and brand owners.

### Where do I register for plastic packaging EPR?

Obligated entities register on the CPCB's centralized EPR portal for plastic packaging, where quantities and categories of packaging placed on the market are reported and EPR certificate fulfillment is tracked.

### Have these rules changed recently?

Yes -- the Plastic Waste Management framework has been amended multiple times since its 2016 baseline, including EPR-specific guidelines and single-use plastic provisions. Check the current consolidated rule text rather than relying on the original 2016 rules alone.
