# Product Recall Procedures in India: Consumer Protection, BIS, and CDSCO

India's product recall framework involves three overlapping regulatory bodies — CCPA for consumer goods, BIS for its certified products, and CDSCO for medical devices. A voluntary recall executed well, with early authority notification and comprehensive collection, typically results in better regulatory outcomes than a forced recall following CCPA action.

## Recall triggers and legal basis

### Safety defect causing or likely to cause injury

Consumer Protection Act 2019, Section 20

CCPA (Central Consumer Protection Authority) can direct mandatory recall and/or impose penalty. Liability on manufacturer/importer.

### BIS non-compliance found during market surveillance

BIS Act 2016, Section 14

BIS can require recall, seizure, and destruction of non-compliant products. CRS suspension.

### Serious adverse event / Field Safety Corrective Action

Medical Device Rules 2017 (for medical devices)

CDSCO can direct recall. Import license can be suspended. Similar provisions under Drugs and Cosmetics Act.

### Voluntary recall by manufacturer

Consumer Protection Act 2019 allows voluntary recall with CCPA notification

Proactive recall can limit liability. CCPA acknowledgement of voluntary recall demonstrates responsible action.

## Recall execution process

01

### Identify the scope of affected products

Define exactly which products are affected: model numbers, serial number ranges, batch codes, date ranges. Document the manufacturing or supply chain root cause. Clearly identify the hazard or defect.

02

### Notify regulatory authorities

For consumer products: notify CCPA with a voluntary recall notice. For medical devices: notify CDSCO within required timelines. For BIS-certified products: notify BIS CRS authority. Early voluntary notification demonstrates good faith and can limit regulatory enforcement action.

03

### Notify distributors and retailers

Issue urgent written notices to all Indian distributors, retailers, and e-commerce platforms carrying the product. Instruct them to: stop sales, quarantine stock, and prepare for collection. Obtain acknowledgement from each distributor.

04

### Notify consumers directly (if possible)

Use registration data, warranty cards, or e-commerce platform seller data to notify consumers who purchased affected products. CCPA may require direct consumer notification for serious safety defects.

05

### Operate the recall collection and remedy

Establish collection points or logistics for product return. Define the remedy: refund, repair, or replacement. Document all returned units with batch/serial numbers. Maintain records of collection quantities.

06

### Investigate root cause and CAPA

Complete root cause analysis. Implement corrective and preventive actions (CAPA) addressing the root cause. Report CAPA to regulators if required. Update product safety risk assessment.

07

### File completion report with authorities

Submit recall completion report to CCPA and other notified regulators. Include: number of units recalled, collection rate, remedy provided, and CAPA implemented.

## Frequently asked questions

### Is there a mandatory product recall obligation under Indian consumer law?

Yes. Under the Consumer Protection Act 2019 and Central Consumer Protection Authority (CCPA) Guidelines, manufacturers and importers can be directed by CCPA to compulsorily recall products that pose safety risks. CCPA can issue recall orders and impose penalties of up to ₹10 lakh (first offense) and ₹50 lakh (subsequent offense) for defective products. The CCPA also has authority to direct consumer compensation. Voluntary recalls initiated before CCPA action are treated more favorably.

### How do I notify affected consumers for a recall in India if I don't have their contact details?

For products sold through e-commerce platforms (Amazon India, Flipkart), you can request the platform's cooperation in notifying buyers. Platforms have buyer contact mechanisms for safety notifications. For products sold through retail channels, distributor and retailer networks must pass recall notices downstream. Press releases and CCPA's own public notification system can also be used for broad consumer notification when direct contact is not possible. CCPA may issue public notices for serious safety recalls.

### What is the role of the Authorised Indian Representative (AIR) in a product recall?

The AIR holds the regulatory relationship with Indian authorities and is the first point of contact for BIS and WPC recall-related communications. The AIR receives BIS show-cause notices, regulatory correspondence, and must respond within specified timelines. During a recall, the AIR coordinates with the foreign manufacturer and manages all India-side regulatory obligations including CDSCO, BIS, and CCPA notifications. Having a capable, responsive AIR is critical during a recall — a slow AIR can worsen regulatory outcomes.
