# Japan HS Codes and Customs Clearance: Classification, Duty Rates, and EPA Preference for Electronics

Japan Customs administers the country's import process under the Customs Act (Act No. 61 of 1954), and customs duty rates are set in the Customs Tariff Act. Japan uses the six-digit Harmonised System (HS) nomenclature, extended to nine digits for Japan-specific subheadings. For electronics, the difference between HS subheadings can mean the difference between a 0% duty rate and a 3–5% tariff — and between qualifying for an EPA (Economic Partnership Agreement) preferential rate or not. Japan has EPAs with the EU (JEFTA, effective 2019), the UK (JUKEPA, effective 2021), and numerous other trading partners. Correctly classifying your hardware product and applying the applicable EPA rate — backed by the right origin evidence — determines your landed cost in Japan.

## Classification, duty rates, and clearance mechanics

### Chapter 84 and 85: where most electronics sit

HS Chapter 84 covers machinery and mechanical appliances; Chapter 85 covers electrical machinery and equipment. Most consumer electronics and hardware products classify in Chapter 85 — televisions, monitors, and projectors in 85.28; telephones and cellular devices in 85.17; printed circuit assemblies in 85.34; semiconductor devices in 85.41; LED products in 85.41 or 85.43. Industrial hardware crosses into Chapter 84 for pumps, compressors, and precision machinery. Misrouting between chapters is a common classification error.

### Duty rates for common electronics categories

Japan's MFN tariff rates for most electronics in Chapters 84 and 85 are 0%, reflecting Japan's WTO ITA (Information Technology Agreement) commitments. However, ITA coverage is product-specific: some consumer electronics, certain batteries, and some accessories carry positive MFN rates of 3–5%. Japan's Customs Tariff Schedules (available from Japan Customs online) provide the current rate for each 9-digit subheading.

### EPA preferential rates: JEFTA and JUKEPA

Under JEFTA (Japan-EU EPA), most electronics imported from the EU are at 0% immediately or phased to 0% over a schedule. Under JUKEPA (Japan-UK EPA), equivalent treatment applies for UK-origin goods. To claim EPA preference, the importer must hold a valid origin declaration — a statement on the commercial invoice by an EU/UK registered exporter confirming EU/UK origin — or a Certificate of Origin issued by the relevant authority. Japan Customs verifies origin claims and can request additional evidence.

### Japan Customs clearance process

Import clearance is managed through Japan Customs' NACCS system (Nippon Automated Cargo and Port Consolidated System), used by customs brokers. The standard import declaration (輸入申告, yunyū shinkoku) covers: HS code, description, quantity, customs value (CIF basis in Japan), duty rate, consumption tax (currently 10%), and origin. Most electronics clear through formal entry; high-value or controlled goods may require an import licence from METI.

### METI import licensing for controlled goods

Some electronics require a METI import licence before customs clearance — specifically goods that are dual-use, military-technology adjacent, or subject to Japan's Foreign Exchange and Foreign Trade Act (FEFTA) controls. The Foreign Exchange Law (外国為替及び外国貿易法) controls are Japan's version of export controls applied to imports in specific sensitive categories.

## Japan Customs clearance process for electronics importers

01

Classify your product to 9-digit Japan HS code using Japan Customs' official tariff schedule (available at customs.go.jp). Verify the classification at the 4-digit heading level first, then refine to 6-digit and 9-digit subheadings.

02

Determine applicable duty rate: MFN rate from the Customs Tariff Act, and EPA preferential rate if the product is EU, UK, or other EPA-partner origin. Check both rates — if the EPA rate is lower and origin can be substantiated, EPA preference should be claimed.

03

Prepare origin evidence for EPA claims: a registered exporter declaration on the invoice (for JEFTA/JUKEPA) or a Certificate of Origin from the relevant authority. For REX (Registered Exporter) declarations under JEFTA, the EU exporter must be registered in the EU REX database.

04

Engage a licensed customs broker (通関業者, tsuukan gyōsha) to file the import declaration in NACCS. Japan requires customs declarations to be filed through licensed brokers for formal entry — foreign companies cannot self-file.

05

Retain all import documentation — commercial invoice, packing list, bill of lading/airway bill, customs declaration, and origin evidence — for 7 years. Japan Customs has post-clearance audit rights and can demand production of these records.

## Frequently asked questions

### Are all electronics covered by Japan's ITA zero-duty commitment?

No — Japan's ITA coverage is product-specific. The ITA (Information Technology Agreement) covers computers, telephones, semiconductors, network equipment, and certain other IT products. Not all of Chapter 85 is ITA-covered — some batteries, some consumer appliances, certain accessories, and non-IT electronic goods may carry positive MFN rates. The Japan Customs tariff schedule shows the applicable rate for each subheading and must be verified product by product.

### Can I classify the same product as a 'module' rather than a finished product to get a lower duty rate?

Classification is based on the product's objective characteristics at the time of import, following the General Rules for Interpretation (GRI) of the HS. Misclassifying a finished product as an unassembled component or module to access a lower rate is customs fraud. Japan Customs has post-clearance audit capability and levies penalties for incorrect declarations — recovered duty plus penalty surcharges of 10–40% depending on intent.

### What is Japan's consumption tax rate on imports, and is it reclaimed?

Japan's consumption tax (消費税) is currently 10% (reduced rate of 8% for food). It applies to imports on the CIF value plus customs duty. For businesses registered for consumption tax in Japan, import consumption tax is claimable as an input tax credit against consumption tax collected on sales — effectively making it neutral for B2B transactions. For foreign companies without a Japan tax registration, it is an unrecoverable cost.

### What is a Customs Advance Classification Ruling and when should I get one?

Japan Customs offers an Advance Classification Ruling service (事前教示) — a formal written ruling on the HS classification and applicable duty rate for a specific product before importation. Rulings are binding on Japan Customs for the applicable product for 3 years. For high-volume imports or classification borderline cases, an advance ruling eliminates classification risk. Applications are free and typically processed within 30 working days.
