# UAE Food Safety Compliance for Hardware: Federal Law, Dubai Municipality, and ADAFSA Requirements

Hardware that contacts food — kitchen appliances, food preparation equipment, packaging machinery, vending machines, food dispensers — falls under UAE food safety regulation in addition to the standard electrical and conformity requirements. Federal Law No. 2 of 2008 on Food Safety established the national framework; Dubai Municipality's Food Safety Department and Abu Dhabi's Agriculture and Food Safety Authority (ADAFSA) are the two dominant Emirate-level implementers. For hardware companies selling food-contact or food-adjacent equipment into the UAE, understanding which authority applies, what testing they require, and how food-contact material standards work in the UAE is essential before first shipment.

## UAE food safety regulatory framework for hardware

### Federal Law No. 2 of 2008 on Food Safety

The federal Food Safety Law established the UAE Food Safety framework, assigning responsibility to local authorities (Dubai Municipality, ADAFSA in Abu Dhabi) for implementation while setting federal standards. The law applies to food products and to equipment used in food handling, preparation, and packaging — 'food contact materials' in EU parlance.

### Dubai Municipality Food Safety Department

Dubai Municipality's Food Safety Department (FSD) regulates food businesses and food equipment in Dubai. Food-contact equipment must comply with material safety standards — typically referencing US FDA 21 CFR food-contact regulations and/or EU Regulation 10/2011 on plastics food-contact materials, as the UAE adopts international standards rather than developing its own food-contact material specifications. FSD issues approvals for food business operators and inspects food-contact equipment in use.

### Abu Dhabi ADAFSA

The Abu Dhabi Agriculture and Food Safety Authority (ADAFSA) administers food safety in Abu Dhabi, including food-contact equipment. ADAFSA issues food establishment licences that cover the equipment used in food operations. For food equipment importers and sellers, maintaining documentation of food-contact material compliance (referencing US FDA or EU food-contact standards) is required for ADAFSA-licensed operators.

### GSO and ESMA food-contact standards

ESMA and the Gulf Standardization Organization issue standards covering food-contact materials including plastics, metals, and coatings. GSO standards for food packaging and food-contact materials form part of the compliance basis alongside international standards. For hardware with food-contact surfaces, testing to the relevant GSO and international standards and retaining test documentation is expected.

### Import health certificates and pre-clearance

For food-contact equipment that is classified as food processing machinery, Dubai Municipality and ADAFSA may require product pre-clearance or a certificate from the country of export attesting compliance with food safety standards. This is distinct from the general electrical/conformity requirements (ECAS/TDRA) and is specific to the food-safety regulatory stream.

## Food safety compliance process

01

Identify which food-contact surfaces exist in your product and what materials they are — metal alloys, polymers, coatings, gasket materials. Each food-contact material requires compliance documentation.

02

Test food-contact materials to applicable international standards — US FDA 21 CFR (for polymers, metals), EU Regulation 10/2011 (for plastics), or relevant GSO standards. Retain migration testing certificates and material safety data from your supply chain.

03

Determine whether your product requires Dubai Municipality FSD clearance and/or ADAFSA approval for sale to food businesses in Dubai or Abu Dhabi respectively. Both authorities have registration and approval processes for food-contact equipment importers.

04

Prepare an Arabic-language technical specification document for your product that covers food-contact materials, operating temperature ranges, and cleaning/sterilization compatibility — this is typically required as part of the FSD or ADAFSA approval documentation package.

05

Ensure after-sale maintenance and cleaning instructions are available in Arabic, as food equipment operators in the UAE will need these for regulatory compliance of the food businesses using your equipment.

## Frequently asked questions

### Does equipment need a separate food safety approval on top of ECAS electrical certification?

Yes — for electrical food-contact equipment, ECAS covers electrical safety, EMC, and radio compliance. Food safety compliance (material safety for food-contact surfaces, food business equipment approval from FSD or ADAFSA) is a completely separate regulatory stream. Both are required for electrical food-contact equipment sold into the UAE.

### Do appliances with non-direct food contact surfaces (e.g., a refrigerator) need food-contact material testing?

For surfaces that don't directly contact food — the exterior of a refrigerator, the motor housing — food-contact material standards don't apply. For interior surfaces that food or food packaging sits on (refrigerator shelves, drawer liners), food-contact compatibility is a reasonable quality and regulatory expectation. FSD and ADAFSA inspect food businesses' equipment in use and have authority over what's acceptable in a licensed food establishment.

### Are US FDA 21 CFR food-contact clearances accepted in the UAE?

Generally yes — UAE Emirate-level food safety authorities reference US FDA and EU food-contact standards as the primary international benchmarks. Products with US FDA 21 CFR food-contact compliance documentation are typically well-received by Dubai Municipality FSD and ADAFSA. The UAE does not have its own comprehensive food-contact material testing infrastructure, so international certifications carry significant weight.

### What are the penalties for selling non-compliant food-contact equipment?

Dubai Municipality FSD and ADAFSA have authority to withdraw equipment from food establishments, revoke food establishment licences of operators using non-compliant equipment, and issue fines. For importers, ESMA market surveillance can issue product withdrawal orders. Food safety non-compliance is taken seriously in the UAE — the authorities are active in inspecting food businesses, and equipment compliance failures surface through those inspections.
