# UK Construction Products Regulation After Brexit: UKCA and National Routes

Construction products represent one of the most complex post-Brexit compliance situations. CE marking continues to be accepted in Great Britain, but manufacturers still need UK-specific Declarations of Performance. The UKCA route is available but not yet mandatory. Understanding which route applies to your product — and what documentation is actually required — prevents costly delays in the specification and procurement cycle.

## Compliance routes for GB market

### CE marking (currently accepted in GB)

**Applies to:** Construction products with harmonised standards under the EU CPR where CE marking was in place before the UK's own framework became mandatory

CE marking still accepted indefinitely in Great Britain for most construction products covered by the EU CPR. UK Government has committed to maintaining this recognition.

Monitor OPSS guidance — timeline for requiring UKCA for construction products has been updated multiple times

### UKCA marking (UK CPR route)

**Applies to:** Products where a GB-specific Technical Assessment has been issued, or where GB-designated standards exist and are applied

UKCA marking is available for construction products but the UK CPR implementation has faced delays. Not yet mandatory for products that can use CE.

UK Technical Assessment Bodies (TABs) issue UK Technical Assessments where no harmonised standard exists

### Voluntary assessment (non-CE/UKCA products)

**Applies to:** Construction products not covered by a harmonised standard — fit for purpose requirements under the Construction Products Regulations 2013 (as amended)

Products must still be fit for use and meet any Building Regulations performance requirements. Third-party certification (e.g., BBA, BREEAM) is common for market differentiation.

No mandatory conformity mark for products outside harmonised standards scope

## Key GB-designated standards by product category

CategoryStandardGB Status

02Technical documentation evidencing performance assessment (test reports, calculation methods, type testing certificates)

03UK Technical Assessment (where product uses Technical Assessment route instead of standard)

04Third-party certification certificates where required by the assessment system

05Instructions for use and installation information required for the declared uses

06UK-designated standard references used for assessment

## Frequently asked questions

### Must I replace CE marking with UKCA marking on construction products sold in Great Britain?

Not currently. The UK Government has confirmed that CE marking for construction products covered by EU harmonised standards will be accepted indefinitely in Great Britain. There is no published mandatory transition date requiring UKCA for construction products. However, you must still issue a UK-format Declaration of Performance (referencing UK regulations) when placing construction products on the GB market, even if using CE marking.

### What are 'Construction Products Regulations 2013' and how do they differ from EU CPR?

The UK retained the EU Construction Products Regulation as UK law (Construction Products Regulations 2013, as amended) after Brexit. The core framework — harmonised standards, essential characteristics, Declarations of Performance — mirrors the EU CPR. The main differences are: UK Technical Assessment Bodies (not European TABs) issue UK Technical Assessments; references in documentation cite UK legislation not EU regulations; and the UKCA marking replaces the CE marking for products pursuing the full UK route.

### Do Building Regulations performance requirements affect construction product compliance?

Yes — and critically. Meeting CPR/CE/UKCA requirements for construction products is a market access requirement, but it does not automatically mean a product meets the performance requirements of UK Building Regulations for a specific application. Specifiers and contractors must verify the product's declared performance against Building Regulations Approved Documents for the intended use. The DoP declares what performance the product achieves; Building Regulations determine what performance is needed.
