# UK E-Commerce Compliance: Amazon UK, eBay, and Online Marketplace Obligations

Selling products online in the UK triggers the same product safety obligations as physical retail — plus additional marketplace-specific requirements and energy labelling rules that OPSS actively enforces with digital sweeps. Listing suspensions, ASIN removals, and seller account restrictions for product safety reasons can be avoided with the right documentation strategy.

## Platform-specific compliance requirements

### Amazon UK

* •Products must have valid UKCA or CE marking (where required)
* •Listings must not make false or misleading safety claims
* •Energy labels must be displayed on listings for Ecodesign-regulated products
* •PSTI Statement of Compliance required for connected consumer products from April 2024
* •Amazon may request compliance documentation at any time — have DoC and technical file ready

**Enforcement:** Amazon can remove listings for product safety concerns; OPSS can contact Amazon to remove non-compliant products

### eBay UK

* •eBay's Dangerous Products Policy prohibits listing non-compliant products
* •UKCA/CE marking must be present where required by UK regulations
* •eBay may request compliance evidence for flagged listings
* •PSTI Statement of Compliance required for consumer IoT products

**Enforcement:** eBay can remove listings and restrict selling privileges for repeated violations

### Etsy, Shopify, and independent e-commerce

* •Same UK product safety obligations apply regardless of platform
* •Consumer protection regulations apply equally — Consumer Rights Act 2015, Consumer Contracts Regulations 2013
* •Distance selling requirements: cooling off period, written contract terms, delivery information

**Enforcement:** OPSS and Trading Standards can investigate and act against sellers on any platform or website

## Online energy label display rules

01Energy labels must be displayed visually near the price for energy-labelled products on online listings

02The label must be displayed before the consumer commits to a purchase — it must be visible on the product listing page, not only at checkout

03Energy label data must be consistent with the product's UK EPLPD (Energy Label Product Database) registration

04OPSS conducts proactive online sweeps for energy label compliance — fines have been issued for missing or incorrect labels on major platforms

05Nested display: the minimum display requirement is to show the energy efficiency class (e.g., 'A', 'B') with a link to the full label. Full label display preferred.

## Frequently asked questions

### If I ship goods from outside the UK directly to UK consumers, do UK product safety rules apply?

Yes. UK product safety regulations apply to products placed on the GB market regardless of where the seller or goods are located. Direct-to-consumer cross-border e-commerce (including from China, USA, and EU) is subject to UK product safety rules. OPSS has specifically targeted direct-from-overseas online sellers for enforcement. The absence of a UK Responsible Person does not exempt overseas sellers — it means OPSS may pursue the platform, the UK importer, or take other enforcement routes. For PSTI specifically, OPSS has express powers to act against overseas manufacturers.

### Can Amazon or eBay be held responsible for selling non-compliant products on their marketplace?

UK law is evolving in this area. Under the UK's Product Safety Review and the Product Safety and Metrology (Great Britain) Bill (progressing through Parliament as of 2025), online marketplaces may face new obligations as 'deemed importers' or 'deemed distributors' for products sold by third-party sellers through their platforms. Currently, OPSS works with platforms to remove non-compliant listings, but the direct liability framework is being updated.

### What compliance documentation should I have ready before listing on Amazon UK?

At minimum: UK Declaration of Conformity (or EU Declaration of Conformity for CE-marked products), applicable test reports, and for connected products, a PSTI Statement of Compliance. For energy-labelled products, your EPLPD registration details. For WEEE-applicable products, proof of UK WEEE producer registration. Amazon may request these at any time for listing approval or in response to product safety flags. Having them organised and accessible prevents listing delays.
