# UK General Product Safety Regulations 2005 (GPSR)

Great Britain and Northern Ireland follow two different general product safety regimes. GB still runs on the General Product Safety Regulations 2005 as its safety-net baseline, while Northern Ireland follows the EU's newer GPSR (Regulation (EU) 2023/988). Selling across the whole UK means knowing which one governs a given product and where.

## What the GB safety net covers

### The core general duty

The 2005 Regulations require that any product supplied to consumers in Great Britain be safe under normal or reasonably foreseeable use — a general safety net that applies whenever a more specific sector regulation (such as electrical safety or machinery rules) does not already govern the product.

### A safety net, not a marking scheme

Unlike UKCA marking regimes, the 2005 Regulations do not require a conformity mark. They impose a general safety duty and, where a more specific route exists, that specific route takes precedence and the GPSR duty sits behind it as a backstop.

### Post-market obligations

The Regulations carry post-market duties too — monitoring safety, cooperating with OPSS on corrective action, and informing the regulator of a known risk are ongoing obligations, not just a point-of-sale requirement.

## How GB diverges from Northern Ireland

### Northern Ireland follows EU GPSR

Because of Northern Ireland’s different post-Brexit arrangements, NI applies the EU’s General Product Safety Regulation (Regulation (EU) 2023/988) — a materially updated 2023 EU law — for covered consumer products, rather than the older GB 2005 Regulations.

### EU GPSR is broader on some points

The EU GPSR (applicable from December 2024) introduced explicit online marketplace obligations, new traceability requirements, and updated risk-assessment expectations that go beyond the GB 2005 baseline — meaning a product safe under the GB regime is not automatically compliant with the newer NI/EU regime.

### Practical effect for GB/NI sellers

A company selling the same consumer product into both Great Britain and Northern Ireland is, in effect, working under two different general-safety frameworks and should check both rather than assuming one clears both markets.

## Applying the GB general safety duty

01

Check whether a more specific UK sector regulation (electrical safety, machinery, toys, etc.) already governs your product — if so, that regime, not the 2005 Regulations, is your primary compliance route.

02

Where no specific regime applies, assess your product against the general safety duty using relevant standards, published guidance, or comparable products as a benchmark.

03

Maintain traceability and post-market monitoring processes so you can respond quickly if OPSS raises a concern.

04

For products also sold in Northern Ireland, separately confirm compliance with the EU GPSR requirements that apply there rather than assuming GB compliance is sufficient.

## Frequently asked questions

### Does the GPSR 2005 require a UKCA mark?

No. The General Product Safety Regulations 2005 impose a general safety duty rather than a conformity-marking scheme. UKCA marking applies under separate, sector-specific UK regulations that take precedence over the general safety net where they apply.

### Why does Northern Ireland use a different general safety law than Great Britain?

Northern Ireland’s post-Brexit trade arrangements mean it continues to follow relevant EU product rules for goods, including the EU’s updated General Product Safety Regulation, rather than the older GB-specific 2005 Regulations that apply in England, Scotland, and Wales.

### Which regulator enforces the GPSR 2005 in Great Britain?

The Office for Product Safety and Standards (OPSS) is the lead national regulator for general product safety in Great Britain, working alongside local Trading Standards authorities for enforcement.

### If my product is compliant with the GB 2005 Regulations, is it automatically compliant in Northern Ireland?

Not automatically. Northern Ireland follows the newer EU GPSR, which includes requirements — such as specific online marketplace obligations and updated risk-assessment expectations — that go beyond the GB 2005 baseline. Each regime should be checked separately for products sold into both markets.
