# UK OPSS Market Surveillance: Enforcement Powers and Product Safety Investigations

OPSS (Office for Product Safety and Standards) is the UK's national product safety regulator. It has significant enforcement powers — including the ability to suspend and ban products, require recalls, and impose financial penalties reaching £10 million. Understanding OPSS's powers, how investigations are triggered, and how to respond effectively is essential for any manufacturer or importer placing products on the GB market.

## OPSS enforcement powers

### Compliance notice

**When used:** When OPSS believes a product does not meet legal requirements but no immediate safety risk is identified

**Effect:** Requires the business to bring products into compliance within a specified timeframe. Business must report back to OPSS.

**Penalty for breach:** Non-compliance with a compliance notice can lead to prosecution

### Suspension notice

**When used:** When OPSS needs time to investigate whether a product is compliant and an immediate decision is needed

**Effect:** Temporarily prevents the business from placing, supplying, or making available the product while investigation continues

**Penalty for breach:** Breaching a suspension notice is a criminal offence

### Stop notice

**When used:** When OPSS is satisfied that a product poses a risk or does not comply with requirements

**Effect:** Prevents the business from placing, supplying, or making the product available until compliance is demonstrated

**Penalty for breach:** Financial penalties up to £10,000 per day or criminal prosecution

### Recall notice

**When used:** When OPSS considers a product already on the market or with consumers poses a serious risk

**Effect:** Requires the business to contact consumers and arrange return or remedy. Must be coordinated with OPSS.

**Penalty for breach:** Financial penalties and criminal prosecution for non-compliance

### PSTI-specific financial penalties

**When used:** Non-compliance with PSTI Act minimum security requirements

**Effect:** OPSS can issue monetary penalties

**Penalty for breach:** Up to £10 million or 4% of qualifying worldwide revenue — whichever is higher

## How OPSS investigations progress

01

### Trigger — how investigations begin

OPSS investigations are triggered by: consumer complaints; Trading Standards referrals; border force alerts on non-compliant imports; proactive market surveillance testing; intelligence from industry or sector bodies; product incident reports.

02

### Initial contact

OPSS typically sends an initial letter or email requesting information: product documentation, compliance evidence, technical file, Declaration of Conformity. Respond promptly — non-response increases enforcement risk.

03

### Documentation review

OPSS examines the technical file, test reports, Declaration of Conformity, and related compliance evidence. Missing or inadequate documentation is itself an indicator of non-compliance.

04

### Physical product testing

OPSS may commission testing of products purchased on the market. Products that fail testing against designated standards trigger formal enforcement action.

05

### Formal enforcement or resolution

If non-compliance is confirmed: formal notice issued, corrective action required, penalties assessed. Voluntary corrective action taken early (before formal notice) typically results in more favourable treatment.

## Frequently asked questions

### What should I do if OPSS contacts me about a product compliance concern?

Respond promptly and professionally. Do not ignore OPSS communications — silence escalates investigations. Gather all technical documentation (Declaration of Conformity, technical file, test reports) and present it clearly. If you believe the product is compliant, explain why with supporting evidence. If you identify a genuine compliance gap, proactive voluntary corrective action — including contacting OPSS with a corrective action plan — typically results in significantly better outcomes than waiting for formal enforcement action.

### Can OPSS target products sold by overseas businesses directly to UK consumers?

Yes. OPSS has jurisdiction over products placed on the GB market regardless of where the seller is based. For online sales, OPSS has worked with major platforms including Amazon and eBay to remove non-compliant listings. Under the PSTI Act, OPSS has specific powers to take action against overseas manufacturers and importers who are non-compliant. The UK Responsible Person (for products requiring one) is also a domestic enforcement point for overseas manufacturers.

### Does OPSS publish information about enforcement actions?

Yes — OPSS publishes product recalls, safety alerts, and enforcement case summaries on the Product Safety Database (find.gov.uk) and on gov.uk. Businesses subject to public enforcement actions face reputational as well as financial consequences. OPSS also shares information with Trading Standards, border force, and overseas regulators through international product safety networks.
