# UK Product Recall Procedures: OPSS, Consumer Rights Act, and Corrective Action

A product recall is one of the most operationally and reputationally disruptive events a manufacturer or importer can face. Having a recall plan, understanding OPSS notification obligations, and knowing how to execute a recall effectively can mean the difference between a managed corrective action and an enforcement escalation. This guide walks through every stage of the UK recall process.

## What triggers a UK product recall

### OPSS-directed recall

Mandatory

OPSS issues a recall notice under the General Product Safety Regulations or sector-specific regulations when a product already with consumers presents a serious risk. The business must comply with the notice terms.

### Voluntary recall (manufacturer-initiated)

Voluntary

Manufacturer or importer identifies a safety issue and voluntarily recalls the product — proactively notifying OPSS before taking corrective action. Demonstrates good faith; may result in more favourable regulatory treatment.

### Post-market surveillance triggered recall

Voluntary

A recall is triggered following post-market surveillance findings: field incident reports, consumer complaints, test lab findings on production samples, or analysis of returned units.

### Court order or Trading Standards action

Mandatory

In serious cases, Trading Standards or courts can order product removal and recall. This is a last resort — most recalls are handled through OPSS or voluntarily.

## Recall execution: step-by-step

01

### Notify OPSS immediately

For serious safety risks, notify OPSS immediately — before public announcement. OPSS provides a reporting mechanism through the Product Safety Database (find.gov.uk). Early notification demonstrates responsible action and allows OPSS to provide guidance on the recall scope.

02

### Identify affected product scope

Determine the date range, batch numbers, or serial numbers of affected units. Define the geographic scope (GB only, or also EU and other markets requiring parallel notifications to other regulators).

03

### Assess remedy options

Determine what the recall remedy will be: full refund, replacement, free repair, or software update (for software-related issues in connected products). The remedy must address the safety risk — a partial fix that does not eliminate the risk is not acceptable.

04

### Consumer notification campaign

Notify consumers through: direct contact where customer registration data exists; point of sale retailers; press release / media notification for widespread products; social media; prominent notice on product website. OPSS may provide guidance on notification scope.

05

### Track and report remediation rate

OPSS expects businesses to track what percentage of affected units have been remediated. Report progress to OPSS as agreed. Low remediation rates may trigger additional enforcement action or mandatory media campaigns.

06

### Root cause analysis and corrective action

Document the root cause of the safety issue and the corrective actions taken in the production process or product design to prevent recurrence. OPSS may require this as part of the recall conclusion.

## Frequently asked questions

### Is there a legal duty to report a product safety issue to OPSS in the UK?

Yes. Under the General Product Safety Regulations 2005 (and the forthcoming Product Safety and Metrology (Great Britain) Bill), producers and distributors have an obligation to notify OPSS when they have information that a product they have placed on the market presents or may present a risk to consumers. The threshold for notification is a 'risk' — you do not need to wait for a confirmed incident to report. Failure to notify OPSS when there is a reportable risk is a criminal offence.

### What is the difference between a product recall and a product withdrawal?

A product withdrawal removes products from the supply chain (from distributor shelves, retail stock, and the distribution network) before they reach consumers. A product recall brings products back from consumers who have already purchased and received them. Both may be necessary simultaneously — if stock in the supply chain is unsafe, a withdrawal is needed; if consumer-held units are unsafe, a recall is needed. OPSS communications and public reporting will specify which actions are required.

### Can a software update substitute for a physical product recall for connected products?

Potentially yes, if the software update fully remedies the safety risk and can be reliably deployed to all affected units. For connected products where the safety issue is software-based (e.g., a cybersecurity vulnerability or a functional safety bug in firmware), OPSS may accept a mandatory software update as the recall remedy. The update must be mandatory (not optional), deployed to all affected units, and monitored for completion rate. A voluntary or gradual update rollout does not typically satisfy recall obligations.
