# NFPA 70 / National Electrical Code (NEC) and Hardware Products: What Manufacturers Must Know

### The Three-Layer Stack: NEC, OSHA, and UL

These three systems are distinct but interlocking. NFPA 70 (NEC) is a model installation code adopted by state and local jurisdictions — it governs how electrical systems are installed, not what products are built. OSHA 29 CFR § 1910.303 adopts the NEC for workplace electrical safety and establishes the NRTL (Nationally Recognized Testing Laboratory) program that authorizes bodies like UL, ETL, CSA, and Intertek to certify products. UL listing is the product-level standard; it provides the evidence that the installed product satisfies NEC requirements in a given application.

### Article 110.3(b): The Mechanism That Makes UL Listing Code-Mandatory

NEC Article 110.3(b) states that listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling. This single provision is why UL listing effectively becomes a legal requirement in jurisdictions that have adopted the NEC: if the electrical inspector (AHJ) requires NEC compliance, and the NEC mandates using equipment per its listing instructions, the listing instructions carry the force of code. Ignoring them — even for seemingly minor installation variations — creates AHJ rejection risk and potential liability.

### NRTL Program Under OSHA 29 CFR § 1910.303

OSHA's NRTL program (Nationally Recognized Testing Laboratory) formally recognizes testing labs to certify products for workplace use. Recognition is product-category specific — an NRTL may be recognized for industrial control panels but not for medical equipment. As of 2024, OSHA recognizes 17 NRTLs including UL, CSA Group, Intertek (ETL), MET Laboratories, and TÜV SÜD. For products sold into workplaces or commercial facilities, NRTL listing under an OSHA-recognized lab is the expected baseline. Consumer products sold direct to consumers have more flexibility, but commercial and industrial buyers will typically require it.

### NEC Update Cycle and State Adoption Lag

NFPA publishes a new NEC edition every three years (2017, 2020, 2023, next due 2026). State and local adoption lags substantially — as of mid-2024, approximately 20 states have adopted NEC 2023, while others remain on 2020 or even 2017. This creates a patchwork: a product listing valid under NEC 2023 must still be examined against the edition enforced in the specific jurisdiction. When significant changes occur (e.g., AFCI expansion, EV charging requirements), verify which edition applies in your target markets before committing to a listing configuration.

### NEC 2023 Changes Affecting Hardware Products

NEC 2023 introduced significant changes in three areas relevant to hardware manufacturers: Article 625 and new Article 626 govern EV charging equipment and EV supply equipment, imposing new requirements on charge controllers, cables, and couplers. Article 706 (energy storage systems) was substantially revised with new battery management and disconnect requirements. Arc fault circuit interrupter (AFCI) protection expanded to additional room types, affecting any plug-connected appliance or device used in those spaces. Products in these categories may require updated listing to reflect the 2023 rules.

### Authority Having Jurisdiction (AHJ): Who Actually Enforces This

The AHJ is the organization, office, or individual responsible for enforcing NEC requirements in a given locality — typically the local building or electrical inspector. AHJs have significant discretion: they can accept unlisted equipment if they determine it is equivalent to listed equipment, or they can reject listed equipment that fails to meet local amendments. In practice, most AHJs default to requiring NRTL listing and will not process unlisted equipment without an engineering evaluation letter. For commercial product launches in regulated facilities (hospitals, data centers, industrial plants), the installer's AHJ relationship is a deployment dependency you must account for.

## NEC compliance pathway for hardware products

Identify which NEC articles apply to your product type. Consumer electronics sold direct typically need to consider Articles 100–110 (general definitions and installation requirements), the applicable equipment article, and any AFCI/GFCI provisions. EV charging, energy storage, or industrial products have dedicated articles (625, 626, 706, 409) with more specific requirements.

Determine which NRTL listing is commercially necessary for your target markets. Industrial and commercial buyers in regulated facilities will almost universally require NRTL listing. Identify which NRTL programs cover your product category — not all NRTLs are recognized for all categories under OSHA's program.

Engage an NRTL early in the design phase. UL, ETL (Intertek), CSA, and MET Labs all offer pre-submission consultations. Identify the applicable UL standard (e.g., UL 60950-1 for IT equipment — now largely superseded by UL 62368-1, which became mandatory in December 2020) and get a gap analysis before tooling is finalized.

Ensure listing instructions clearly define permitted installation configurations. Article 110.3(b) means your listing instructions are effectively code. Specify allowable environments (dry, damp, wet), temperature ranges, wire gauge requirements, and enclosure types with precision — vague instructions create field interpretation problems and AHJ rejection risk.

Review state and local NEC adoption status in your primary target markets. Where NEC 2023 is adopted, verify your listing addresses 2023-specific requirements. Where older editions apply, confirm your listing remains valid under those editions — NRTL certificates typically reference the applicable code edition.

## Frequently asked questions

### Is NEC compliance mandatory for hardware products or just for installers?

Technically, the NEC is an installation code — it binds the installer, not the manufacturer. However, NEC Article 110.3(b) requires that listed equipment be used per its listing instructions, and most AHJs require NRTL listing as a condition of approving an electrical installation. In practice, if your hardware product will be installed in any commercial, industrial, or multifamily residential setting subject to electrical inspection, it must carry an appropriate NRTL listing — otherwise the installer cannot get a code-compliant inspection sign-off. For direct-to-consumer products not subject to inspection, NRTL listing is technically voluntary but commercially expected for anything that plugs into mains power.

### What's the difference between UL listing and NEC compliance?

UL listing is a product certification issued by UL (an NRTL) attesting that the product meets specified safety standards for its category. NEC compliance is a property of an electrical installation — it means the installation meets the requirements of whatever NEC edition the local jurisdiction has adopted. These intersect through NEC Article 110.3(b): once your product is UL-listed, an installer who follows the listing instructions is generally compliant with the NEC for that equipment. But a UL-listed product installed in a way that violates the listing instructions (wrong gauge wire, wrong enclosure rating, wrong ambient temperature) is not NEC-compliant even though the product itself is listed. Manufacturers cannot make their products 'NEC compliant' — only a specific installation can be compliant.

### Which states are currently on NEC 2023?

As of mid-2024, states that have adopted NEC 2023 include California, Colorado, Florida, Georgia, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Mexico, North Carolina, North Dakota, Oregon, South Carolina, South Dakota, Tennessee, and several others. Major holdouts include New York, Texas, and Illinois, which operate on NEC 2020 or in some cases NEC 2017 with local amendments. New York City, notably, uses its own Electrical Code. State adoption status changes regularly — the NFPA maintains a current adoption map at nfpa.org/codes-and-standards. Never assume adoption; always verify against the specific jurisdiction for any deployment.

### Do I need a separate UL listing for each state?

No. A UL listing (or any NRTL certification) is a single national certification — it does not need to be repeated state by state. The listing is issued against a specific product standard (e.g., UL 62368-1) and is recognized by all AHJs that accept NRTL certifications, regardless of which state they are in. However, if local jurisdictions have adopted local amendments to the NEC that impose requirements beyond what the applicable UL standard covers, the AHJ may require additional documentation or an engineering evaluation. This is uncommon for standard commercial electronics but more frequent for specialized equipment in heavily-regulated sectors like healthcare or hazardous locations.
